【摘要】：反擔保制度乃我國特有制度,從成型到成熟有待時日�，F(xiàn)有反擔保立法過于簡陋,學界亦在債務人以外的第三人是否可以充當反擔保人、定金留置應適用反擔保與否、反擔保復設問題、反擔保責任期間等問題上有所誤讀,應有定論。對于反擔保制度在擔保方式、主合同之認定等問題上,立法應予明文確定;對于反擔保易被惡意利用問題,必須要對主體之主觀要件進行考量,比對其主觀惡意程度,探究以當事人內(nèi)心真意作為裁判依據(jù),否則極易造成利益失衡。
[Abstract]:The system of counterguarantee is unique to our country, and it will take some time from its formation to maturity. The existing anti-guarantee legislation is too rudimentary, whether the third party other than the debtor can act as the counterguarantor, and whether the deposit lien should be applied to the counterguarantee or not, There should be a definite conclusion on the problems of counterguarantee reinstatement, the period of counterguarantee liability and so on. For the anti-guarantee system in the way of guarantee, the confirmation of the main contract, and so on, the legislation should be explicitly determined; as for the problem that counter-guarantee is easy to be used maliciously, It is necessary to consider the subjective elements of the subject, than to its subjective malice degree, to explore the truth of the parties as the basis for adjudication, otherwise it is easy to cause interest imbalance.
