【摘要】：簡單類型化的成年人行為能力欠缺制度隨著社會的發(fā)展尤其是老齡化社會的到來凸顯出諸多問題,并且和聯(lián)合國《殘疾人權(quán)利公約》第12條規(guī)定相悖,應(yīng)予修改,替代其功能的是新型成年監(jiān)護(hù)制度�！睹穹ǹ倓t》應(yīng)該從理念上確認(rèn)屬于協(xié)助決策模式的新型成年監(jiān)護(hù)制度,通過援助成年障礙者利用殘存的判斷能力進(jìn)行決定而實(shí)現(xiàn)其利益。在具體交易場合,成年被監(jiān)護(hù)人需要監(jiān)護(hù)人幫助其完成自主意思的表達(dá),從而以具體法律關(guān)系中判斷意思能力的規(guī)則代替成年人行為能力欠缺的認(rèn)定,依據(jù)被監(jiān)護(hù)人行為時(shí)的具體精神狀況確定其所為法律行為的效力。
[Abstract]:With the development of the society, especially the arrival of the aging society, the simple type of adult behavioral disability system highlights many problems, which is contrary to the provisions of article 12 of the United Nations Convention on the Rights of Persons with Disabilities and should be amended. The new adult guardianship system is replaced by its function. The General principles of Civil Law should confirm the new adult guardianship system which belongs to the mode of assisting in decision-making. The interests of adults with disabilities are realized by assisting them to use their residual judgement to make decisions. In specific transactions, adult guardians need guardians to help them complete the expression of their autonomous meaning. Thus, the rules of judging will capacity in specific legal relations can replace the recognition of adults' lack of capacity, and determine the validity of the legal act according to the specific mental condition of the person under guardianship.
