【摘要】:商標(biāo)申請等活動具有較強(qiáng)的專業(yè)性,如涉及對擬申請商標(biāo)是否可能被準(zhǔn)予注冊的判斷,需要大量的相關(guān)專業(yè)知識和經(jīng)驗(yàn),所以在實(shí)踐中大量的企業(yè)和市場主體會選擇聘請商標(biāo)代理人代理其辦理商標(biāo)相關(guān)的事項(xiàng)。隨著我國經(jīng)濟(jì)的發(fā)展和社會的進(jìn)步,一方面,國內(nèi)企業(yè)和各類市場主體也越來越意識到了商標(biāo)對于企業(yè)發(fā)展的重要性和經(jīng)濟(jì)價值;另一方面,在國內(nèi)市場對外日益開放的今天,大量外國企業(yè)、公司已經(jīng)或正在進(jìn)入中國市場,而根據(jù)《商標(biāo)法》的規(guī)定,外國企業(yè)或者外國公民不能直接在中國申請辦理商標(biāo)注冊或者其他與商標(biāo)相關(guān)的行政程序,而必須通過委托商標(biāo)代理機(jī)構(gòu)進(jìn)行辦理。這些因素促使了我國商標(biāo)代理行業(yè)的蓬勃發(fā)展,目前我國商標(biāo)代理行業(yè)也已經(jīng)較為壯大,上至頂級國際律師事務(wù)所,如英國的Magic Circle Law Firms、美國的White Shoes Law Firms,下至街頭巷尾的小型商標(biāo)代理公司,都參與到了商標(biāo)代理活動中,形成了從高端到低端俱全的市場格局。我國的商標(biāo)代理市場雖然具有一定的規(guī)模,但是仍然是個年輕且不成熟的市場,也存在著大量商標(biāo)代理人在執(zhí)業(yè)中存在不當(dāng)行為的現(xiàn)象。而目前我國法律對商標(biāo)代理人的規(guī)定很少,導(dǎo)致相關(guān)人的權(quán)益無法得到充分的保障。本文針對此問題進(jìn)行了探討,提出了引入專家責(zé)任彌補(bǔ)現(xiàn)行法律的不足。本文分為三個部分,主要內(nèi)容如下:在第一部分中,本文介紹了商標(biāo)代理相關(guān)的現(xiàn)行法律制度、相關(guān)概念,并且總結(jié)了一部分實(shí)踐中的案例以及通過案例可以發(fā)現(xiàn)的問題。該部分旨在分析現(xiàn)行法律制度存在的問題。第二部分中,本文對專家責(zé)任制度進(jìn)行了介紹,專家是執(zhí)業(yè)專家應(yīng)當(dāng)承擔(dān)的責(zé)任,其的法理基礎(chǔ)是專業(yè)性較強(qiáng)的行業(yè)中,由于一般委托人很難對該行業(yè)的知識有所了解,所以要求專家承擔(dān)更嚴(yán)格的幾種特殊義務(wù),在違反這些義務(wù)時也需要承擔(dān)相應(yīng)責(zé)任。商標(biāo)代理人屬于專家的一種,其也有著行業(yè)本身的特殊性,引入專家責(zé)任制度對商標(biāo)代理行業(yè)進(jìn)行規(guī)制能較好地解決實(shí)踐當(dāng)中出現(xiàn)的問題,并且與我國原有法律與體系較為契合。該部分旨在分析在商標(biāo)代理行業(yè)引入專家責(zé)任制度的可行性和必要性。而在第三部分中,本文對引入專家責(zé)任制度后的商標(biāo)代理人的義務(wù)和責(zé)任進(jìn)行了分類介紹。本文商標(biāo)代理人的的義務(wù)根據(jù)相對方的不同可以分為對委托人應(yīng)當(dāng)承擔(dān)的義務(wù)以及對委托人之外的相關(guān)第三人應(yīng)當(dāng)承擔(dān)的義務(wù)。兩種義務(wù)的基礎(chǔ)并不相同,并且內(nèi)容也有所不同。而商標(biāo)代理人在未妥善履行上述義務(wù)時,有可能引發(fā)其專家責(zé)任。而商標(biāo)代理人應(yīng)對委托人和相關(guān)代理人承擔(dān)的專家責(zé)任的基礎(chǔ)、構(gòu)成要件、具體內(nèi)容也有著差異。
[Abstract]:Trademark application and other activities are highly professional. If it involves judging whether the trademark is likely to be registered, it will require a large amount of relevant professional knowledge and experience. Therefore, in practice, a large number of enterprises and market entities will choose to hire trademark agents to handle trademark related matters. With the development of our economy and social progress, on the one hand, Domestic enterprises and all kinds of market entities have also become increasingly aware of the importance and economic value of trademarks for the development of enterprises. On the other hand, today, when the domestic market is increasingly open to the outside world, a large number of foreign enterprises, The company has entered or is entering the Chinese market, and according to the provisions of the Trademark Law, foreign enterprises or foreign citizens cannot directly apply for trademark registration or other administrative procedures related to trademarks in China, The trademark agency must be entrusted to handle it. These factors have promoted the vigorous development of the trademark agency industry in China. At present, the trademark agency industry in our country has also become stronger, reaching to the top international law firms. For example, Magic Circle Law Firmsin the UK, White Shoes Law Firmsin the United States, and small trademark agencies down the street, are all involved in trademark agency activities. Although the trademark agency market in China has a certain scale, it is still a young and immature market. There is also a large number of trademark agents in the practice of misconduct phenomenon. But at present, there are few regulations on trademark agents in our country, resulting in the rights and interests of related persons can not be fully protected. This article is divided into three parts: in the first part, this paper introduces the current legal system related to trademark agency, related concepts, This part aims to analyze the problems existing in the current legal system. In the second part, the author introduces the expert liability system. Experts are professional experts should bear the responsibility, its legal basis is more professional industry, because the general client is very difficult to understand the knowledge of the industry, so experts are required to undertake more stringent several special obligations. In violation of these obligations, they also have to bear the corresponding liability. Trademark agents belong to one of the experts, and they also have the particularity of the industry itself. The introduction of expert liability system to regulate the trademark agency industry can solve the problems in practice. The purpose of this part is to analyze the feasibility and necessity of introducing expert liability system in trademark agency industry. This paper introduces the duties and responsibilities of trademark agents after introducing the system of expert liability. The obligations of trademark agents can be divided into the obligations to the principal and to the commission according to the different parties. Obligations to be assumed by a third person other than a trust. The basis of the two obligations is not the same, And the content is also different. When the trademark agent fails to properly fulfill the above obligations, it may lead to its expert responsibility. And the basis of the trademark agent's expert responsibility to the principal and the relevant agent, the constituent elements, The concrete content also has the difference.
