【摘要】：編纂民法典是當(dāng)下法學(xué)界的頭等大事,在此種熱情高漲激情澎湃的背后,需要冷靜思考后續(xù)影響,特別是當(dāng)前的憲法秩序能否保障民法典頒布之后順利實施。民法典對民事關(guān)系的調(diào)整并不是孤立的真空的,而是存在于形形色色客觀真實的物質(zhì)世界中,容易受多種因素的影響。通過比較研究的方法,從古今中外民法典實施狀況的對比中可以發(fā)現(xiàn),沒有良好的憲法秩序,民法典最終將淪為一紙空文。當(dāng)前憲法秩序中仍然存在一些阻礙民法典順利實施的因素,如憲法定位有所偏離被局限于公法領(lǐng)域,長期以來憲法缺位導(dǎo)致憲法權(quán)威受損,公民法治意識淡薄私權(quán)主體尚不發(fā)達(dá)等。憲法學(xué)者需審慎思考該如何有效規(guī)范公權(quán)力,并提升公民的憲法意識和權(quán)利保護(hù)思維,促進(jìn)私權(quán)主體特別是公益組織的有序發(fā)展,為民法典的實施創(chuàng)造良好的法治環(huán)境。
[Abstract]:The codification of the civil code is a top priority in the legal community at present. Behind this enthusiasm and enthusiasm, we need to think calmly about the follow-up influence. In particular, whether the current constitutional order can guarantee the smooth implementation of the Civil Code after its promulgation. The adjustment of civil relations in the Civil Code is not an isolated vacuum, but exists in a variety of objective and real material worlds. It is easy to be influenced by many factors. Through the method of comparative study, we can find that there is no good constitutional order from the comparison of civil codes in ancient and modern times. The civil code will eventually be reduced to a dead letter. There are still some obstacles to the smooth implementation of the civil code in the current constitutional order, such as the deviation of the constitutional position is confined to the field of public law, and the absence of the constitution for a long time results in the damage of the constitutional authority. Constitutional scholars should carefully consider how to regulate public power effectively, promote citizens' constitutional consciousness and right protection thinking, and promote the orderly development of private rights subjects, especially public welfare organizations. To create a good legal environment for the implementation of the Civil Code.
