【摘要】：正懸賞通緝是一種高效率、市場(chǎng)化的事實(shí)發(fā)現(xiàn)機(jī)制,是偵查機(jī)關(guān)利用經(jīng)濟(jì)杠桿激勵(lì)公眾主動(dòng)提供破案線索的一種偵查行為。目前,學(xué)術(shù)界對(duì)于懸賞通緝的性質(zhì)爭(zhēng)論較大,原因在于懸賞通緝具有雙重性質(zhì),對(duì)其不同理解導(dǎo)致實(shí)踐中產(chǎn)生較多問(wèn)題。筆者對(duì)懸賞通緝的第一層性質(zhì)和第二層性質(zhì)進(jìn)行抽絲剝繭的分析,希望有助于厘清問(wèn)題,對(duì)實(shí)踐有所裨益。一、懸賞通緝的含義與特征懸賞通緝?cè)诟拍钍褂蒙陷^為混亂,多種表達(dá)并存。厘清懸賞通緝含義,需要對(duì)懸賞通緝與懸賞廣
[Abstract]:Being wanted for reward is an efficient and market-oriented mechanism for finding facts. It is a kind of investigation behavior that the investigating organs use economic leverage to motivate the public to provide clues to solve cases. At present, the nature of the reward is controversial in academic circles. The reason lies in the dual nature of the reward wanted, and the different understanding of it leads to more problems in practice. The author analyzes the first layer and the second layer nature of the reward, hoping to help clarify the problem. It is beneficial to practice. First, the meaning and characteristics of the wanted for a reward is confused in the use of the concept, and a variety of expressions coexist. To clarify the meaning of the wanted for a reward, it is necessary to offer a reward and a broad reward.
