【摘要】：《民法總則》繼承與發(fā)展了《民法通則》、最高人民法院《民法通則意見(jiàn)》、《合同法》等既有代理制度,對(duì)我國(guó)現(xiàn)行代理制度做了較為系統(tǒng)的整理與發(fā)展�！睹穹ǹ倓t》以法律行為作為代理的客體,以直接代理作為代理基本形式,并揚(yáng)棄了指定代理的分類(lèi),體現(xiàn)了代理制度對(duì)以往制度的合理繼承。職務(wù)代理規(guī)定以及對(duì)無(wú)權(quán)代理人責(zé)任作出的詳細(xì)規(guī)定等,則體現(xiàn)了本章對(duì)代理制度的合理發(fā)展。但是,對(duì)代理授權(quán)以及代理無(wú)因性未予明確規(guī)定、對(duì)無(wú)權(quán)代理人責(zé)任制度規(guī)定得不夠完善,又說(shuō)明其仍待加強(qiáng);而對(duì)違法代理的規(guī)定以及間接代理制度的闕如等,則反映出代理制度一章仍存在一定的不足。
[Abstract]:The "General principles of Civil Law" inherited and developed the "General principles of Civil Law", the Supreme people's Court "opinions on the General principles of Civil Law", "contract Law" and other existing agency systems, The present agency system of our country has been systematically sorted out and developed. The General principles of Civil Law regard legal acts as the object of agency, direct agency as the basic form of agency, and discard the classification of appointed agents. It reflects the reasonable succession of the agency system to the previous system, the provisions of the post agency and the detailed provisions on the responsibility of the unauthorized agent, which reflects the reasonable development of the agency system in this chapter. The absence of clear provisions on agency authorization and agency without cause, or on the imperfect regulation of the system of liability of unauthorized agents, also indicates that it still needs to be strengthened, while the provisions on illegal agency and the absence of indirect agency system, etc. It reflects that there are still some shortcomings in the chapter of agency system.
