【摘要】：微博作為一種新興的網(wǎng)絡傳播媒介以有限的文本形式，在促進信息傳播與共享的同時也引發(fā)了著作權問題的法律思考。雖然微博的著作權問題與傳統(tǒng)的著作權問題沒有什么本質(zhì)上的區(qū)別，但是微博本身的匿名性、分享性、即時性、簡短性等特征也為著作權的保護提出了新的挑戰(zhàn)。什么樣的微博內(nèi)容受著作權法的保護，以及微博內(nèi)容具有獨創(chuàng)性在認定標準都需要進行一定程度的探討。本文在微博內(nèi)容享有著作權的情形下，分析了微博著作權侵權行為的認定及構成，，基于對微博著作權問題的初步理論研究具體分析了微博平臺上可能發(fā)生的侵權行為，提出微博內(nèi)容符合著作權保護的判斷標準，闡述了解決微博著作權問題的CC協(xié)議和ODR網(wǎng)絡著作權爭端解決機制，立足在法律保護層面之外，能夠提供一些有建設性的意見。
[Abstract]:Weibo, as a new network medium, has a limited text form. While promoting the dissemination and sharing of information, it also leads to legal consideration of the copyright issue. Although Weibo's copyright problem is no different from the traditional copyright issue in essence, the anonymity, sharing, and immediacy of Weibo itself, Brevity and other features also pose a new challenge to the protection of copyright. What kind of Weibo content is protected by copyright law, As well as Weibo's originality and originality, we need to discuss to a certain extent the criteria for determining the content. In the case of the copyright enjoyed by Weibo's content, this paper analyzes the identification and composition of the copyright infringement act of Weibo. Based on the preliminary theoretical research on Weibo's copyright problem, this paper concretely analyzes the possible infringement actions on Weibo platform, and puts forward that the content of Weibo conforms to the judgment standard of copyright protection. This paper expounds the CC protocol and the ODR network copyright dispute settlement mechanism for Weibo, which can provide some constructive suggestions based on the legal protection.
