【摘要】：傳統(tǒng)侵權(quán)法拒絕將比較過錯(cuò)制度適用于故意侵權(quán)領(lǐng)域,作為拒絕適用依據(jù)的"性質(zhì)不同"理論、"補(bǔ)償受害人、威懾并懲罰侵權(quán)人"的政策依據(jù)及故意侵權(quán)不能比較之傳統(tǒng)規(guī)則,都受到一定的挑戰(zhàn)。因果關(guān)系分配責(zé)任之標(biāo)準(zhǔn)、"性質(zhì)不同"理論的外強(qiáng)中干、單獨(dú)侵權(quán)人應(yīng)為各自行為的份額負(fù)責(zé)任、嚴(yán)格責(zé)任領(lǐng)域適用比較過錯(cuò)的嘗試等都為比較過錯(cuò)適用于故意侵權(quán)提供了合理性依據(jù)。在解決"過失侵權(quán)人可能承擔(dān)高于故意侵權(quán)人比例的責(zé)任、不可知或非當(dāng)事人的侵權(quán)人過錯(cuò)比例能否比較及受害人不能受償部分如何分配"這些問題的基礎(chǔ)上,未來《民法典·侵權(quán)責(zé)任法》應(yīng)當(dāng)考慮將比較過錯(cuò)制度適用于主觀故意不明顯的故意侵權(quán)、主觀故意明顯但有誘發(fā)性原因的故意侵權(quán)等特殊領(lǐng)域,當(dāng)事人的過失可減輕故意侵權(quán)人責(zé)任,以及將比較過錯(cuò)制度適用于一般情形下過失侵權(quán)人責(zé)任比例的確定,這不涉及故意侵權(quán)人責(zé)任的減輕。
[Abstract]:The traditional tort law refuses to apply the system of comparative fault to the field of intentional tort, which is based on the theory of "different nature", the policy basis of "compensating the victim, deterring and punishing the infringer" and the traditional rule that the intentional infringement cannot be compared. The criteria for the allocation of liability for causality, the "different nature" theory of external power, the individual infringer should be responsible for their respective acts of the share of the responsibility, The attempt to apply comparative fault in strict liability field provides a reasonable basis for comparing fault to intentional infringement. In solving the problem that "the negligent infringer may bear the responsibility higher than the proportion of intentional infringer," On the basis of the question whether the proportion of infringers who are unknowable or non-litigants can be compared and how the part of the victim cannot be reimbursed is distributed ", In the future, the Civil Code 路Tort liability Law should consider applying the system of comparative fault to the special fields such as intentional tort with unobvious subjective intent, intentional tort with obvious subjective intent but with inductive reasons, and so on. The negligence of the party concerned can reduce the liability of the intentional infringer and apply the system of comparative fault to the determination of the proportion of the liability of the tortfeasor under general circumstances, which does not involve the mitigation of the liability of the intentional infringer.
