【摘要】：同一債權(quán)既有人的擔(dān)保又有物的擔(dān)保的,在擔(dān)保權(quán)可得行使時(shí),債權(quán)人應(yīng)當(dāng)按照約定實(shí)現(xiàn)債權(quán)。這里的"約定",應(yīng)是當(dāng)事人之間關(guān)于人的擔(dān)保和物的擔(dān)保之間責(zé)任順序、責(zé)任分擔(dān)范圍的約定,而非實(shí)現(xiàn)擔(dān)保物權(quán)的約定。在解釋論之下,我國實(shí)定法并不承認(rèn)保證人與物上保證人之間的求償關(guān)系,在債務(wù)人提供物的擔(dān)保的情形,當(dāng)事人如無上述約定,債權(quán)人應(yīng)先就債務(wù)人提供的物的擔(dān)保實(shí)現(xiàn)債權(quán),債權(quán)人放棄該物的擔(dān)保的,其他擔(dān)保人在債權(quán)人喪失優(yōu)先受償權(quán)益的范圍內(nèi)免除擔(dān)保責(zé)任,但當(dāng)事人如有上述約定,債權(quán)人應(yīng)當(dāng)按照該約定實(shí)現(xiàn)債權(quán),債權(quán)人放棄該物的擔(dān)保的,對(duì)其他擔(dān)保人承擔(dān)擔(dān)保責(zé)任不發(fā)生影響。第三人提供物的擔(dān)保的,當(dāng)事人如無上述約定,債權(quán)人可以選擇向保證人或物上保證人主張權(quán)利,債權(quán)人放棄物上保證人提供的物的擔(dān)保,對(duì)保證人承擔(dān)保證責(zé)任不發(fā)生影響。立法上應(yīng)承認(rèn)保證人與物上保證人之間的內(nèi)部求償權(quán),如無相反約定,債權(quán)人放棄物上保證人的物的擔(dān)保,保證人在物上保證人應(yīng)分擔(dān)份額的范圍內(nèi)免除擔(dān)保責(zé)任。
