【摘要】：維吾爾傳統(tǒng)民族醫(yī)藥是中醫(yī)藥的重要組成部分,是維吾爾族的傳統(tǒng)民族醫(yī)學(xué)技術(shù)與其傳統(tǒng)文化知識融合的產(chǎn)物,帶有獨特的民族特點和地域風(fēng)格。維吾爾傳統(tǒng)民族醫(yī)藥的歷史悠久,其傳承與發(fā)展受到了中醫(yī)藥的巨大影響,具有自己特色鮮明的基礎(chǔ)體系和精湛的臨床經(jīng)驗,是中國醫(yī)藥學(xué)與維吾爾傳統(tǒng)文化知識寶典的重要組成部分。長期以來,維吾爾傳統(tǒng)民族醫(yī)藥與中醫(yī)藥共同發(fā)展,相互交融,跟其他一些少數(shù)民族的醫(yī)藥一同構(gòu)成了體系比較完整的中華傳統(tǒng)醫(yī)藥。然而,受到其他因素的影響,其傳統(tǒng)民族醫(yī)藥的知識產(chǎn)權(quán)沒有得到高度重視,從而制約了傳統(tǒng)民族醫(yī)藥的產(chǎn)業(yè)化發(fā)展。隨著國家對“一帶一路”戰(zhàn)略的推進,我國對傳統(tǒng)民族醫(yī)藥在其繼承與發(fā)展方面給予了相當(dāng)大的重視,為我國帶有民族特色的傳統(tǒng)民族醫(yī)藥的進步與發(fā)展奠定了扎實基礎(chǔ)。本文對于維吾爾傳統(tǒng)民族醫(yī)藥的知識產(chǎn)權(quán)保護從以下五個部分進行論述:第一部分,引言。這部分對該論題的研究目的、研究意義以及國內(nèi)外研究現(xiàn)狀等進行簡要論述,為開展課題研究奠定理論基礎(chǔ)。第二部分,論證維吾爾傳統(tǒng)民族醫(yī)藥知識產(chǎn)權(quán)保護的必要性。為便于了解維吾爾傳統(tǒng)民族醫(yī)藥的概貌,論文首先梳理了維吾爾傳統(tǒng)民族醫(yī)藥的概念、特征和發(fā)展現(xiàn)狀等,進而著重論證了維吾爾傳統(tǒng)民族醫(yī)藥知識產(chǎn)權(quán)保護的重要意義,認(rèn)為保護維吾爾傳統(tǒng)民族醫(yī)藥知識產(chǎn)權(quán),有利于傳承維吾爾傳統(tǒng)民族醫(yī)藥知識、規(guī)范維吾爾傳統(tǒng)民族醫(yī)藥產(chǎn)業(yè)和維護維吾爾傳統(tǒng)民族醫(yī)藥利益。第三部分,介紹國外傳統(tǒng)醫(yī)藥知識產(chǎn)權(quán)的保護制度。首先對于該領(lǐng)域的國際立法現(xiàn)狀進行論述,然后概括了部分國家對傳統(tǒng)醫(yī)藥知識產(chǎn)權(quán)的保護措施。第四部分,概括維吾爾傳統(tǒng)民族醫(yī)藥知識產(chǎn)權(quán)的保護現(xiàn)狀及存在的問題。分別從商標(biāo)保護、地理標(biāo)志保護、著作權(quán)保護、商業(yè)秘密保護等方面進行論述。第五部分,針對維吾爾傳統(tǒng)民族醫(yī)藥知識產(chǎn)權(quán)保護存在的問題,分別從專利、商標(biāo)、地理標(biāo)志、著作權(quán)、商業(yè)秘密以及非物質(zhì)文化遺產(chǎn)保護等方面,提出完善建議,以期對我國維吾爾傳統(tǒng)民族醫(yī)藥的發(fā)展有所裨益。
[Abstract]:Traditional Uygur medicine is an important part of traditional Chinese medicine, and it is the product of the fusion of traditional ethnic medicine technology and traditional cultural knowledge of Uygur nationality. With unique national characteristics and regional style. Uygur traditional ethnic medicine has a long history, its inheritance and development has been greatly affected by traditional Chinese medicine, with its own distinctive characteristics of the basic system and exquisite clinical experience, It is an important component of Chinese medicine and Uygur traditional cultural knowledge. For a long time, traditional Uygur medicine and traditional Chinese medicine have developed and blended with each other. Along with the medicine of some other ethnic minorities, it constitutes a relatively complete system of Chinese traditional medicine. However, under the influence of other factors, the intellectual property rights of its traditional national medicine have not been highly valued. As a result, the industrialization of traditional national medicine has been restricted. With the promotion of Belt and Road's strategy, China has attached great importance to the inheritance and development of traditional national medicine. It lays a solid foundation for the progress and development of traditional ethnic medicine with ethnic characteristics in China. This paper discusses the intellectual property protection of traditional ethnic medicine in Uygur from the following five parts: the first part, Introduction. This part briefly discusses the purpose of the topic, the significance of the research and the current situation of the research at home and abroad, laying a theoretical foundation for the development of the subject. The second part, This paper demonstrates the necessity of intellectual property protection of traditional Uygur national medicine. In order to understand the general picture of Uygur traditional ethnic medicine, the paper firstly combs the concept, characteristics and development status of Uygur traditional ethnic medicine. Furthermore, the importance of intellectual property protection of traditional Uygur national medicine is emphatically demonstrated, and it is considered that the protection of intellectual property rights of traditional Uygur national medicine is conducive to the transmission of traditional Uyghur national medicine knowledge. Standardizing Uygur traditional national medicine industry and safeguarding the interests of Uighur traditional national medicine. The third part introduces the protection system of intellectual property rights of foreign traditional medicine. First, it discusses the current situation of international legislation in this field. Then summarizes the protection measures of traditional medicine intellectual property rights in some countries. Part 4th, summarizes the current situation and existing problems of the protection of traditional Uygur traditional medicine intellectual property rights. Respectively from trademark protection, geographical indication protection, copyright protection, In part 5th, in view of the problems existing in the protection of intellectual property rights of traditional Uygur national medicine, respectively, from the aspects of patents, trademarks, geographical indications, copyright, etc., In order to benefit the development of traditional Uygur medicine in China, some suggestions are put forward in the aspects of trade secret and protection of intangible cultural heritage.
