【摘要】：新聞聚合是新聞作品傳播的新方式。新聞作品個(gè)性化、交互式的傳播有利于社會(huì)公益,同時(shí)也可能危及著作權(quán)人的核心利益。在新的技術(shù)條件和傳播環(huán)境下,有必要在選擇進(jìn)入機(jī)制這一傳統(tǒng)著作權(quán)法規(guī)制模式之下,探索在特定條件之下選擇退出機(jī)制存在的空間。非自愿許可機(jī)制與合理使用制度的效用發(fā)揮有利于平衡著作權(quán)保護(hù)與作品有效傳播中的私人利益與社會(huì)公益。
[Abstract]:News aggregation is a new way to spread news works. The individualized and interactive communication of news works is beneficial to the public good, and may also endanger the core interests of copyright owners. It is necessary to choose access mechanism, which is the traditional regulation mode of copyright law. This paper explores the space of choosing exit mechanism under certain conditions. The utility of involuntary licensing mechanism and rational use system is beneficial to balance the private interests and social welfare in copyright protection and effective dissemination of works.
