【摘要】：對于民間借貸涉罪案件,司法機(jī)關(guān)依照"先刑后民"的原則進(jìn)行處理,導(dǎo)致諸多理論弊端和實(shí)務(wù)困境。根據(jù)刑法適用統(tǒng)一性的要求處理刑民交叉案件,首先應(yīng)明確違法性判斷的理論。在民間借貸涉罪案件中,民事違法不是肯定刑事違法的前提性條件,如果因借貸合同無效或者因意思瑕疵導(dǎo)致合同可撤銷,應(yīng)先從民事角度對被害人的相關(guān)權(quán)益進(jìn)行救濟(jì),不能均以犯罪論處。在具體路徑建構(gòu)中,應(yīng)當(dāng)從程序啟動和實(shí)體判決兩方面予以完善。
[Abstract]:As for the cases involving folk loan and loan, the judicial organs deal with the cases according to the principle of "first punishing the people before the people", which leads to many theoretical malpractices and practical dilemmas. According to the requirement of the unity of the criminal law application, the judicial organs deal with the cross-criminal cases. First of all, we should make clear the theory of judgment of illegality. In the case of civil lending related crimes, civil violation is not a prerequisite for affirming criminal illegality. If the loan contract is invalid or the contract can be revoked because of the defect of the meaning, It is necessary to remedy the victims' rights and interests from a civil point of view, not all of them be treated as crimes. In the construction of specific paths, we should perfect them from two aspects: the start of procedure and the substantive judgment.
