【摘要】：黨的十八屆三中全會通過的《中共中央關于全面深化改革若干重大問題的決定》(以下簡稱《決定》)中,明確了賦予農(nóng)民以土地為主的財產(chǎn)權利,是我國農(nóng)村土地制度歷史性突破。全球信息化時代的呼聲,促使國家經(jīng)濟快速發(fā)展;社會結構的優(yōu)化轉型,催生了法治時代下農(nóng)村土地經(jīng)營制度的創(chuàng)新性改革。農(nóng)地產(chǎn)權制度的完善與農(nóng)戶土地財產(chǎn)權的明晰,印證法治社會下農(nóng)戶權利的政策支持與法律保障。而土地所有權、承包權與經(jīng)營權的分置,亦進一步推動農(nóng)地財產(chǎn)物權化、市場化流轉。然而,如何在宏觀土地政策“有形手”的指引下,將農(nóng)村土地經(jīng)營權融入市場這只“無形手”當中,不斷深化農(nóng)業(yè)經(jīng)濟新型時代的改革,使其集約化、規(guī)�；l(fā)展,值得思索與探討。本文在堅持農(nóng)村集體土地所有權性質(zhì)的前提下,運用法學理論與實踐相結合的方法,探討農(nóng)村土地承包權與經(jīng)營權相分離有關問題,厘清農(nóng)村承包土地流轉的特殊性,闡明經(jīng)營權固有的用益物權屬性與物權性流轉的市場效益。通過對土地現(xiàn)狀困境的描述,探索農(nóng)村土地經(jīng)營權市場化流轉的路徑,詮釋農(nóng)民承包土地所蘊含的財產(chǎn)性權利。同時,借鑒國內(nèi)外科學合理的農(nóng)地流轉制度,契合公權與私權的法律制度,使社會資源“物盡其用”,從而不斷完善我國新型農(nóng)地經(jīng)營權流轉制度。

The farmland property right system and perfect the rural land property rights clear, policy support and legal protection of farmers' rights confirmed under the rule of law and land ownership, contract rights and management rights division, will further promote the farmland property right, market transfer. However, how to guide the macro land policy "visible hand", the rural land management right into the market this "invisible hand", deepening The new era of reform of agricultural economy, the intensive, large-scale development, is worth thinking and discussion. This paper based on the rural collective land ownership, the law using the method of combination of theory and practice, some problems on the rural land contract right and management right are separated, clarify the particularity of rural land circulation. The right to operate, to clarify the inherent attribute of usufructuary right and property right transfer market efficiency. Based on the current situation of land situation description, explore the path of rural land management rights transfer market, the interpretation of farmers' land contract contains property rights. At the same time, from the domestic and foreign scientific and reasonable land circulation system, the legal system of public power and fit right, so that social resources "make", so as to continuously improve the circulation model of China's agricultural land management right system.
