【摘要】：正2016年4月溫州市發(fā)生的住宅建設(shè)用地使用權(quán)續(xù)期(以下簡稱"自動(dòng)續(xù)期")的事件引起了民眾、學(xué)者以及國家部門的熱切關(guān)注。目前對該問題的學(xué)術(shù)討論主要集中于兩個(gè)方面:第一,在私法層面聚焦于如何理解《物權(quán)法》第149條"自動(dòng)續(xù)期"及其立法背景解讀等;第二,在程序法層面則體現(xiàn)為政府如何在程序上解決自動(dòng)續(xù)期的問題。上述討論無疑具有重要價(jià)值,但并未涵蓋自動(dòng)續(xù)期
[Abstract]:On April 2016, the event of renewal of the right to use residential construction land (hereinafter referred to as "automatic renewal") that occurred in Wenzhou City aroused the public. The current academic discussion on this issue is mainly focused on two aspects: first, focusing on how to understand the "automatic renewal" of article 149 of the Real Law and its legislative background in the private law; second, the interpretation of the legislative background, and so on. At the level of procedural law, it is reflected in how the government resolves the issue of automatic renewal in procedure. The above discussion is undoubtedly of great value, but it does not cover automatic renewal
