【摘要】:隨著知識(shí)經(jīng)濟(jì)時(shí)代的發(fā)展,知識(shí)產(chǎn)權(quán)作為一種無(wú)形資產(chǎn)己成為經(jīng)濟(jì)發(fā)展的重要依托。而今世界旅游業(yè)不斷地蓬勃發(fā)展,我國(guó)加入WTO后旅游業(yè)的全面開(kāi)放和知識(shí)產(chǎn)權(quán)保護(hù)的國(guó)際化發(fā)展,使旅游業(yè)將面臨更大的競(jìng)爭(zhēng)和挑戰(zhàn),我國(guó)旅游業(yè)知識(shí)產(chǎn)權(quán)保護(hù)將成為制約我國(guó)旅游業(yè)經(jīng)濟(jì)發(fā)展的關(guān)鍵問(wèn)題。在知識(shí)經(jīng)濟(jì)時(shí)代中的旅游線(xiàn)路的著作權(quán)法律保護(hù)問(wèn)題也越加凸顯。筆者認(rèn)為要清楚的認(rèn)識(shí)到旅游線(xiàn)路的創(chuàng)新舉措才是推動(dòng)旅游市場(chǎng)良性發(fā)展的重要?jiǎng)恿?而我國(guó)旅游產(chǎn)業(yè)尚屬新興產(chǎn)業(yè),旅行社的產(chǎn)品主要是旅游線(xiàn)路,也是開(kāi)發(fā)者為旅行社帶來(lái)的巨大收益。利益熏心的旅游經(jīng)營(yíng)者對(duì)旅游線(xiàn)路的“克隆”已成為越來(lái)越普遍的行為,以至于旅游產(chǎn)品相互抄襲,缺乏個(gè)性及吸引力,從而導(dǎo)致旅游市場(chǎng)在著作權(quán)保護(hù)方面存在混亂無(wú)序的局面。因此,為了促進(jìn)旅游業(yè)蓬勃發(fā)展,必須適用著作權(quán)法律制度對(duì)旅游線(xiàn)路加以保護(hù)。然而,現(xiàn)階段我國(guó)缺乏具有針對(duì)性的相關(guān)法律保護(hù)制度,這已經(jīng)成為社會(huì)中絕對(duì)不容忽視的平臺(tái)。本文中筆者選擇旅游線(xiàn)路的概念界定作為研究對(duì)象,在充分認(rèn)識(shí)旅游線(xiàn)路構(gòu)成要素中所涉及獨(dú)創(chuàng)性問(wèn)題的分析基礎(chǔ)上,透析我國(guó)現(xiàn)有的著作權(quán)法法律制度適用于保護(hù)旅游線(xiàn)路設(shè)計(jì)成果的缺陷進(jìn)而分析解決問(wèn)題,建立旅游線(xiàn)路的著作權(quán)保護(hù)機(jī)制和對(duì)旅游線(xiàn)路構(gòu)成要素的實(shí)踐探索,完善我國(guó)旅游線(xiàn)路法律保護(hù)制度的可操作性是研究解決這一現(xiàn)實(shí)問(wèn)題的有效途徑。進(jìn)而保護(hù)旅游線(xiàn)路開(kāi)發(fā)者的合法權(quán)利,保障旅游產(chǎn)業(yè)的進(jìn)一步發(fā)展。
[Abstract]:With the development of the era of knowledge economy, intellectual property as an intangible asset has become an important support for economic development. After China's entry into WTO, the tourism industry will face greater competition and challenge due to the overall opening of tourism industry and the internationalization of intellectual property protection. The protection of tourism intellectual property rights in China will become a key problem restricting the economic development of tourism industry in China. In the era of knowledge economy, the legal protection of the copyright of tourism routes has become more and more prominent. The author thinks that we should have a clear understanding of it. The innovative measures to travel routes are the important driving force to promote the sound development of the tourism market. However, the tourism industry in China is still a new industry. The products of travel agencies are mainly tourist routes, and they are also the huge profits that developers bring to travel agencies. The "cloning" of tourist routes by tour operators with strong interests has become a more and more common behavior. As a result, tourism products copy each other, lack of personality and attraction, resulting in the tourism market in the copyright protection in a chaotic situation. Therefore, in order to promote the development of tourism, The copyright legal system must be applied to protect tourist routes. However, at the present stage, there is no relevant legal protection system in China. This has become a platform that can not be ignored in the society. In this paper, the author chooses the definition of tourism route as the object of study, on the basis of fully understanding the original problems involved in the elements of tourism route, This paper analyzes the defects of the existing legal system of copyright law applicable to the protection of the design results of tourism routes, and then analyzes and solves the problems, establishes the copyright protection mechanism of tourism routes, and explores the practical exploration of the constituent elements of tourism routes. It is an effective way to study and solve this practical problem by perfecting the operability of the legal protection system of tourism routes in our country, thus protecting the legitimate rights of the developers of tourism routes and ensuring the further development of the tourism industry.
