【摘要】：學(xué)生傷害事故是以民事行為能力為標(biāo)準(zhǔn)進(jìn)行歸責(zé)的,學(xué)校責(zé)任受其影響,監(jiān)護(hù)人責(zé)任亦是如此。學(xué)校責(zé)任經(jīng)歷了從"有限適用過錯(cuò)責(zé)任"到"區(qū)別適用過錯(cuò)推定責(zé)任"的演變,而監(jiān)護(hù)人責(zé)任也歷經(jīng)了從"絕對(duì)適用無過錯(cuò)責(zé)任"到"區(qū)分適用公平責(zé)任"的變化。對(duì)于學(xué)生直接遭受學(xué)校侵害以及校內(nèi)第三人的人身傷害來說,年齡下調(diào)雖減輕了學(xué)校的舉證責(zé)任,卻加重了監(jiān)護(hù)人的舉證負(fù)擔(dān);對(duì)于學(xué)生致人損害而言,年齡下調(diào)雖未影響學(xué)校責(zé)任,卻顯著加重了監(jiān)護(hù)人責(zé)任;對(duì)于學(xué)生遭受校外第三人的人身傷害而論,年齡下調(diào)無論是對(duì)學(xué)校責(zé)任還是監(jiān)護(hù)人責(zé)任,均無實(shí)質(zhì)影響。為此,學(xué)校應(yīng)做好安全保障工作,并將辦學(xué)活動(dòng)納入責(zé)任保險(xiǎn)范圍;而監(jiān)護(hù)人則應(yīng)善盡監(jiān)護(hù)職責(zé),并提高證據(jù)收集的意識(shí)和能力。
[Abstract]:The student injury accident is imputed according to the standard of civil capacity, the school responsibility is affected by it, so is the guardian responsibility. The school responsibility has evolved from "limited applicable fault liability" to "distinguishing the application of presumption of fault liability". The responsibility of guardian has also gone through the change from "absolute application of no-fault liability" to "differentiated application of fair liability". Although the downward adjustment of age lightens the burden of proof in schools, it increases the burden of proof of guardians; for students, although it does not affect the responsibility of schools, it significantly increases the burden of guardians; As for students who suffer personal injury from the third person outside school, the downward adjustment of age has no substantial effect on school responsibility or guardian responsibility. Therefore, the school should do a good job of safety and security, and bring school running activities into the scope of liability insurance; The guardian should do his duty of guardianship and improve the consciousness and ability of evidence collection.
