【摘要】：隨著信息化產(chǎn)業(yè)的發(fā)展,網(wǎng)絡在人們生產(chǎn)、生活中的作用顯得愈發(fā)重要。作為網(wǎng)絡信息技術與現(xiàn)代金融相結合產(chǎn)物的網(wǎng)絡金融正以迅猛的速度對我們的社會生活產(chǎn)生深遠影響。由于金融消費者在市場交易中的弱勢地位,使得其權益特別是隱私權常常受到侵害。金融消費者隱私權是傳統(tǒng)隱私權在金融領域的延伸,是金融消費者的重要權利之一。金融消費者隱私權不僅應該作為一種獨立的人格權進行保護,而且它還是一種財產(chǎn)權屬性越來越明顯的積極的人格權。第一部分:引言,主要介紹了本文的選題背景及研究意義,在分析國內(nèi)外研究現(xiàn)狀的基礎上闡述本文所研究的內(nèi)容。第二部分:通過分析對金融消費者隱私權的概念進行了界定,闡明了金融消費者隱私權的內(nèi)容及其權能,對金融隱私權與其他隱私權的區(qū)別進行了分析。第三部分:對金融消費者隱私權的基礎理論進行研究,明確人格尊嚴是金融消費者隱私權保護的邏輯起點和價值取向,財產(chǎn)性權利為金融消費者隱私權保護的核心內(nèi)容。第四部分:從我國金融消費者隱私權受到侵害的現(xiàn)狀分析入手,進而歸納總結出其表現(xiàn)形式。第五部分:對我國金融消費者隱私權的法律保護現(xiàn)狀進行梳理并指出存在的問題。第六部分:以英美日為例,對其金融消費者隱私權保護方面的立法模式、立法制度等進行介紹,借鑒國外的有益立法經(jīng)驗和保護模式。第七部分:從立法方面提出適合我國國情的金融消費者隱私權保護機制的有關設想和立法建議。
[Abstract]:With the development of information industry, the network is produced by people. The role of life is becoming more and more important. As a result of the combination of network information technology and modern finance, network finance is having a profound impact on our social life at a rapid speed. Because of the weak position of financial consumers in market transactions, Financial consumer privacy is an extension of traditional privacy in the financial field. The right to privacy of financial consumers should be protected not only as an independent personality right, but also as a positive personality right with more and more obvious property attributes. This paper mainly introduces the background and significance of this paper, and expounds the content of this paper based on the analysis of the current research situation at home and abroad. Part two: through the analysis of the concept of financial consumer privacy is defined. This paper expounds the content and power of financial consumer's right to privacy, analyzes the difference between financial privacy and other privacy rights. Part three: the basic theory of financial consumer's right to privacy is studied. Making it clear that human dignity is the logical starting point and value orientation of the protection of the right to privacy of financial consumers, Property right is the core content of financial consumer privacy protection. Part 4th: from the analysis of the current situation of financial consumer privacy infringement in China, Then summarizes its manifestation. 5th part: combing the current situation of the legal protection of the right to privacy of financial consumers in China and pointing out the existing problems. 6th part: take Anglo-American Japan as an example, The legislative model and legislative system of the protection of the right to privacy of financial consumers are introduced. Part 7th: from the legislative point of view, the author puts forward some ideas and legislative suggestions on the protection mechanism of the right to privacy of financial consumers, which is suitable for the national conditions of our country.
