【摘要】：城中村改造是我國(guó)社會(huì)發(fā)展的必經(jīng)階段,處理好這個(gè)階段存在的問題,有利于城鎮(zhèn)化建設(shè)的健康發(fā)展。城中村改造拆遷補(bǔ)償安置階段中政府、村民、村集體及開發(fā)商之間有著激烈的利益博弈,自2005年來(lái),因改造產(chǎn)生的糾紛層出不窮,透過這些糾紛案例,可清晰地發(fā)現(xiàn)此階段存在拆遷主體選擇不規(guī)范、補(bǔ)償標(biāo)準(zhǔn)有漏洞、部分安置房不達(dá)標(biāo)、“釘子戶”事件頻繁發(fā)生的問題,解決這些社會(huì)問題在實(shí)踐操作中存在困境,因此探索造成這些問題的法律原因很有必要。如何解決好此階段現(xiàn)存的法律問題,讓被拆遷人清晰地認(rèn)識(shí)到拆遷中存在的利益關(guān)系,找到在現(xiàn)實(shí)拆遷過程中出現(xiàn)矛盾的根源,認(rèn)識(shí)到城中村改造的重大意義,對(duì)于促進(jìn)城中村改造工作的順利進(jìn)行有著極其重要的意義。與此同時(shí)政府和村集體如何準(zhǔn)確把握拆遷過程中運(yùn)用的法律和政策,如何做到科學(xué)決策,對(duì)于拆遷階段依法安置和補(bǔ)償也至關(guān)重要。因此,本文將在闡述城中村改造拆遷安置補(bǔ)償存在的突出問題的基礎(chǔ)之上,對(duì)存在這些突出問題的法律原因進(jìn)行分析,從而提出完善建議。
[Abstract]:The transformation of villages in cities is a necessary stage of social development in our country. It is beneficial to the healthy development of urbanization construction to deal with the problems existing in this stage. The government and villagers in the phase of compensation and resettlement for the reconstruction and relocation of villages in cities, There is a fierce interest game between village collectives and developers. Since 2005, disputes arising from renovation have emerged in endlessly. Through these dispute cases, it can be clearly found that there are irregularities in the selection of demolition subjects and loopholes in compensation standards at this stage. Some of the resettlement houses are not up to the standard, the problems of "nail households" frequently occur, and there are difficulties in the practice of solving these social problems. Therefore, it is necessary to explore the legal reasons that cause these problems. How to solve the existing legal problems at this stage, let the people who have been removed clearly realize the relationship of interest in the demolition, and find out the root of the contradictions in the process of real demolition. Recognizing the great significance of the transformation of villages in cities, which is of great importance for the smooth progress of the transformation of villages in cities, and at the same time how governments and village collectives can accurately grasp the laws and policies applied in the process of demolition and relocation, How to make scientific decision is also very important for the relocation and compensation in accordance with the law. Therefore, this paper will expound the prominent problems existing in the compensation for the relocation of villages in the city. This paper analyzes the legal reasons for these outstanding problems and puts forward some suggestions for perfection.
