【摘要】：在當(dāng)前的司法實(shí)踐中,寄托人精神利益的財(cái)產(chǎn)所引發(fā)的爭議越來越大�！叭烁褙�(cái)產(chǎn)”被從一般意義上的財(cái)產(chǎn)中分離出來,日漸進(jìn)入司法的視野。然而,我國法律并沒有對“人格財(cái)產(chǎn)”的概念,“人格財(cái)產(chǎn)”的判定標(biāo)準(zhǔn)及“人格財(cái)產(chǎn)”受侵害能否要求精神損害賠償?shù)葐栴}做出明確的規(guī)定。本文在參考了眾多文獻(xiàn)資料及相關(guān)外國立法的基礎(chǔ)上,結(jié)合我國立法的現(xiàn)狀試圖對如何定義“人格財(cái)產(chǎn)”的概念,“人格財(cái)產(chǎn)”的特征有哪些,“人格財(cái)產(chǎn)”的評(píng)判標(biāo)準(zhǔn)是什么,及侵害“人格財(cái)產(chǎn)”的表現(xiàn)形式及適用精神損害賠償?shù)囊罁?jù)做出一個(gè)詳細(xì)的闡述,以求探尋完善“人格財(cái)產(chǎn)”法律保護(hù)的有效途徑。本篇文章共分為四個(gè)部分,分別是人格財(cái)產(chǎn)侵害概述,人格財(cái)產(chǎn)侵害能夠主張精神損害賠償?shù)恼?dāng)性分析,人格財(cái)產(chǎn)侵害之精神損害賠償?shù)姆梢?guī)定及存在問題,完善人格財(cái)產(chǎn)法律保護(hù)之建議。文章第一部分重點(diǎn)介紹了“人格財(cái)產(chǎn)”的概念、特征和評(píng)判標(biāo)準(zhǔn)及侵害人格財(cái)產(chǎn)的表現(xiàn)形式。文章第二部分則論述了精神損害賠償?shù)墓δ芗罢埱筚r償?shù)睦碚撘罁?jù)和現(xiàn)實(shí)依據(jù)。文章的第三部分介紹了國內(nèi)外的相關(guān)立法規(guī)定,并對這些規(guī)定進(jìn)行了簡單的評(píng)析。文章的第四部分試圖從責(zé)任承擔(dān)類型,請求主體及賠償數(shù)額的認(rèn)定等方面提出完善“人格財(cái)產(chǎn)”法律保護(hù)的合理化建議。
[Abstract]:In the current judicial practice, the disputes caused by the property entrusted to the spiritual interests of the susignor are becoming more and more serious. "personal property" has been separated from the property in the general sense and gradually entered the judicial field of vision. The concept of "personality property", the judgment standard of "personality property" and the question of whether "personality property" being infringed to demand compensation for spiritual damage are not clearly stipulated in Chinese law. This paper refers to many documents. On the basis of the relevant foreign legislation, According to the present situation of our country's legislation, this paper tries to define the concept of "personality property", what are the characteristics of "personality property", and what is the criterion of "personality property". In order to explore the effective way to perfect the legal protection of "personality property", this article is divided into four parts. It is an overview of personal property infringement, an analysis of the legitimacy of personality property infringement to claim compensation for mental damage, the legal provisions and existing problems of compensation for moral damage caused by personality property infringement. The first part of the article mainly introduces the concept of "personal property". The second part discusses the function of mental damage compensation and the theoretical and practical basis of requesting compensation. The third part of the article introduces the domestic and foreign relevant legislation. The 4th part of the article tries to put forward some reasonable suggestions to perfect the legal protection of "personality property" from the aspects of the type of responsibility, the subject of request and the amount of compensation.
