【摘要】：姓與名如何擇取,屬于個(gè)人受憲法保障的基本權(quán)利。姓名權(quán)的行使方式是姓名登記。對(duì)公安機(jī)關(guān)而言姓名登記應(yīng)該是無(wú)自由裁量權(quán)的羈束行政行為。導(dǎo)致它淪為行政許可行為的主要原因,在于《中華人民共和國(guó)戶口登記條例》對(duì)稱姓與取名等事項(xiàng)未作具體規(guī)定。統(tǒng)一規(guī)范姓名登記、保障姓名權(quán),已是時(shí)代發(fā)展之必需。對(duì)姓名用字、第三姓、撫養(yǎng)方變更未成年子女姓名、基于主觀價(jià)值判斷的姓名變更、姓名變更次數(shù)等議題,未來(lái)立法都應(yīng)持寬松和開放態(tài)度,以充分保障個(gè)人尤其是少數(shù)人的姓名權(quán)。姓名權(quán)對(duì)姓名登記具有防御權(quán)功能,對(duì)姓名登記過(guò)程中的侵害姓名權(quán)現(xiàn)象,法院可對(duì)登記行為實(shí)施司法審查。
[Abstract]:How to choose a surname and a first name, The exercise of the right of name is the registration of the name. For the public security organs, the registration of the name should be an administrative act without discretion, which leads it to become the main reason for the act of administrative license. In the regulations of the people's Republic of China on Household Registration, symmetrical surnames and names are not specifically specified. It is necessary for the development of the times to unify and standardize the registration of names and to protect the right to name. The future legislation should be lenient and open to the issue of changing the names of minor children, name changes based on subjective value judgment, number of changes of names, etc. In order to fully protect the right of name of individual, especially a few, the right of name has the function of defense to the registration of name, and the court may carry out judicial review on the act of registration when the phenomenon of infringing on the right of name in the process of registration of name is violated.
