【摘要】：民法總則在起草過程中關于權利客體制度的條文設計與立法考量,關注到了民法中物與財產(chǎn)制度的現(xiàn)代化發(fā)展,尤其是脫離人體的器官、組織及尸體等人格物、網(wǎng)絡虛擬財產(chǎn)、數(shù)據(jù)信息等新型權利客體對民事權利客體體系的影響,體現(xiàn)了其時代性與前沿性。在考察現(xiàn)代民法中新型權利客體的法律屬性和權利歸屬時可以借助人格理論,關注民事權利主體與客體之間的關系,重視此類財產(chǎn)中的人格利益,保持開放的姿態(tài),為新興權利的發(fā)展提供法律支持。
[Abstract]:In the drafting process of the general principles of civil law, the article design and legislative consideration on the system of the object of right have paid close attention to the modernization development of the property and property system in the civil law, especially in the separation from human organs, tissues and cadavers, and the virtual property on the network. The influence of the new right object, such as data information, on the object system of civil rights reflects its epochal and vanguard character. In the investigation of the legal attribute and the right attribution of the new right object in modern civil law, we can make use of the personality theory. Pay attention to the relationship between the subject and object of civil rights, attach importance to the interests of personality in this kind of property, keep an open attitude, and provide legal support for the development of emerging rights.
