【摘要】：體育賽事組織者只能憑借對賽事場所的物權(quán)設(shè)定他人入場并進(jìn)行直播的條件,不能根據(jù)自身的章程原始取得對直播畫面的著作權(quán)或鄰接權(quán)。由于在對體育賽事進(jìn)行直播時(shí),攝像機(jī)的設(shè)置需要遵循一定規(guī)范,且導(dǎo)播對畫面的選擇需要滿足觀眾的穩(wěn)定預(yù)期,因此獨(dú)創(chuàng)性程度有限。我國《著作權(quán)法》并未將"固定在物質(zhì)載體上"規(guī)定為作品受保護(hù)的前提,同時(shí)還規(guī)定了用于保護(hù)廣播信號的廣播組織權(quán)。降低對獨(dú)創(chuàng)性的要求、將直播畫面認(rèn)定為作品,將在很大程度上降低使廣播組織權(quán)的意義。因此對現(xiàn)場直播畫面的保護(hù),應(yīng)當(dāng)通過完善《著作權(quán)法》對廣播組織權(quán)的規(guī)定加以實(shí)現(xiàn)。
[Abstract]:The organizer of a sports event can only set the conditions for others to enter and broadcast live by virtue of the real right of the place of the event, and cannot acquire the copyright or neighboring right of the live picture originally according to his own articles of association. The setting of the camera needs to follow a certain standard, and the selection of the screen by the director needs to meet the stable expectation of the audience. Therefore, the degree of originality is limited. The copyright Law of our country does not stipulate "fixing on the material carrier" as the prerequisite for the protection of the work, at the same time, it also stipulates the right of broadcasting organization used to protect the broadcast signal, and reduces the requirement of originality. To regard the live picture as a work will greatly reduce the significance of making broadcasting organization right. Therefore, the protection of live broadcast picture should be realized by perfecting the regulation of broadcasting organization right in copyright Law.
