【摘要】：現(xiàn)代消費(fèi)者權(quán)益保護(hù)法的內(nèi)容是由私法和經(jīng)濟(jì)法兩種不同的制度范式構(gòu)成的。這兩種制度范式的不同主要體現(xiàn)在三個(gè)方面:一是消費(fèi)者權(quán)益保護(hù)法保護(hù)什么?對(duì)此,民法范式認(rèn)為其保護(hù)的是體現(xiàn)于具體受害消費(fèi)者的私人物品上的私人利益,而經(jīng)濟(jì)法范式則認(rèn)為其保護(hù)的是體現(xiàn)于消費(fèi)品交易秩序上的公共利益。二是消費(fèi)者權(quán)益保護(hù)法以何保護(hù)?對(duì)此,民法范式保護(hù)客體的屬性決定了權(quán)利是保護(hù)消費(fèi)者利益的最佳工具,而經(jīng)濟(jì)法范式保護(hù)客體的屬性決定了社會(huì)責(zé)任是保護(hù)消費(fèi)者利益的最佳工具。三是消費(fèi)者權(quán)益保護(hù)法如何保護(hù)?對(duì)此,民法范式是以私人主導(dǎo)的事后責(zé)任規(guī)則,主要是依私人為獲得救濟(jì)而提起訴訟為主導(dǎo)來(lái)實(shí)現(xiàn)保護(hù);而經(jīng)濟(jì)法范式則是公共執(zhí)法為主導(dǎo)的以事前規(guī)制規(guī)則,主要是執(zhí)法機(jī)關(guān)為防止損害發(fā)生而制定規(guī)則予以規(guī)導(dǎo)及執(zhí)法,同時(shí)輔以公益訴訟來(lái)實(shí)現(xiàn)。文章以我國(guó)修訂后的"消法",以及最高人民法院有關(guān)審理消費(fèi)者糾紛案件的兩則司法解釋為樣本,采用經(jīng)濟(jì)分析方法,對(duì)兩種"消法"保護(hù)范式保護(hù)的法益、保護(hù)方式以及實(shí)現(xiàn)方式進(jìn)行比較,對(duì)理解或解釋"消法"的經(jīng)濟(jì)法范式予以闡釋,以期對(duì)"消法"未來(lái)的完善以及對(duì)當(dāng)下新制度的恰切解釋提供理論支撐。
[Abstract]:The content of modern consumer rights and interests protection law is composed of two different institutional paradigms of private law and economic law. The differences between these two institutional paradigms are mainly reflected in three aspects: first, what is the protection of consumer rights and interests protection law? In this regard, the paradigm of civil law considers that it protects the private interests embodied in the private goods of the specific aggrieved consumers. The paradigm of economic law holds that it protects the public interest embodied in the order of consumer goods transaction. The second is how to protect the law of consumer rights and interests? In view of this, the nature of object protection in civil law paradigm determines that right is the best tool to protect the interests of consumers. However, the nature of the object protection in the paradigm of economic law determines that social responsibility is the best tool to protect the interests of consumers. Third, how to protect the rights and interests of consumers? In this regard, the paradigm of civil law is the rule of post responsibility, which is mainly based on the private litigation for relief, while the paradigm of economic law is the rule of prior regulation, which is dominated by public law enforcement. It is mainly the law enforcement agencies that make rules to prevent damage and enforce the law. At the same time, it is accompanied by public interest litigation. The article uses the revised "law of extinction" and the two judicial interpretations of the Supreme people's Court concerning the hearing of consumer disputes as samples, and adopts the economic analysis method. This paper compares the legal interests, the ways of protection and the ways of realization of the protection of the two "extinction" protection paradigms, and explains the economic law paradigm of understanding or interpreting the "elimination law". The purpose is to provide theoretical support for the future perfection of the law and the proper interpretation of the present new system.
