【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的普及,網(wǎng)絡(luò)已經(jīng)滲入到人們的生活中。網(wǎng)絡(luò)為民眾的生活提供了便利,而且不同程度上改變了人們的生活。但是近些年網(wǎng)絡(luò)侵犯隱私權(quán)的事件越發(fā)頻發(fā),比如“人肉搜索”事件等。這些侵犯網(wǎng)絡(luò)隱私權(quán)的行為不僅僅是侵害了當(dāng)事人的合法權(quán)益,還導(dǎo)致網(wǎng)絡(luò)環(huán)境的安全性降低,影響互聯(lián)網(wǎng)的發(fā)展。因而,如何在網(wǎng)絡(luò)環(huán)境下保護(hù)公民隱私權(quán)是本文探討的重心。本文選擇以網(wǎng)絡(luò)隱私權(quán)為研究對象,采用比較分析方法對國內(nèi)外如何保護(hù)網(wǎng)絡(luò)隱私權(quán)進(jìn)行比較分析,進(jìn)而為我國如何去保護(hù)網(wǎng)絡(luò)隱私權(quán)提供途徑和積極方法,進(jìn)一步完善的和全面的保護(hù)網(wǎng)絡(luò)隱私權(quán)。在此基礎(chǔ)上,將本文分成四個(gè)部分。第一部分,對網(wǎng)絡(luò)隱私權(quán)的概念進(jìn)行界定,重點(diǎn)對網(wǎng)絡(luò)隱私權(quán)和相關(guān)概念進(jìn)行分析,從而指出網(wǎng)絡(luò)隱私權(quán)侵權(quán)所具有的特征;第二部分,對我國現(xiàn)有的網(wǎng)絡(luò)隱私權(quán)保護(hù)現(xiàn)狀進(jìn)行分析,進(jìn)而提煉出我國網(wǎng)絡(luò)隱私權(quán)的救濟(jì)方式,并對現(xiàn)有救濟(jì)方式進(jìn)行充分的闡述;第三部分,重點(diǎn)對國內(nèi)外的網(wǎng)絡(luò)隱私權(quán)的救濟(jì)方式進(jìn)行比較。主要是從一般人格權(quán)保護(hù)和廣泛隱私權(quán)保護(hù)的角度出發(fā)列舉國外的網(wǎng)絡(luò)隱私權(quán)救濟(jì)方式,進(jìn)而對域外的網(wǎng)絡(luò)隱私權(quán)救濟(jì)方式進(jìn)行評析,并指出對我國借鑒之處;第四部分,針對上文中所提出的網(wǎng)絡(luò)隱私權(quán)的現(xiàn)狀,結(jié)合域外網(wǎng)絡(luò)隱私權(quán)保護(hù)救濟(jì)方式的經(jīng)驗(yàn),進(jìn)而提出建立健全網(wǎng)絡(luò)隱私權(quán)救濟(jì)法律體系、明確我國的網(wǎng)絡(luò)隱私權(quán)救濟(jì)模式、禁止令的設(shè)立、網(wǎng)絡(luò)隱私權(quán)救濟(jì)的配套制度來完善我國網(wǎng)絡(luò)隱私權(quán)救濟(jì)方式。
[Abstract]:With the popularity of Internet technology, the Internet has penetrated into people's lives. The Internet has provided convenience for people's lives, and has changed people's lives to varying degrees. But in recent years, the incidents of Internet violations of privacy have become more and more frequent. For example, "human flesh search" incidents. These violations of network privacy not only infringe upon the legitimate rights and interests of the parties, but also lead to a decrease in the security of the network environment and affect the development of the Internet. As a result, How to protect the privacy of citizens under the network environment is the focus of this paper. This paper chooses the network privacy as the research object, and uses the comparative analysis method to compare and analyze how to protect the privacy of the network at home and abroad. Then provides the way and the positive method for our country to protect the network privacy, further consummates and comprehensively protects the network privacy. On this basis, divides this article into four parts. The first part, Define the concept of network privacy, focus on the analysis of network privacy and related concepts, so as to point out the characteristics of network privacy infringement; the second part, the current status of network privacy protection in China is analyzed. Then extract the relief way of network privacy right in our country, and fully expound the existing relief way; the third part, Comparing the remedies of network privacy at home and abroad. It mainly lists the remedies of network privacy abroad from the point of view of the protection of general personality rights and the protection of extensive privacy rights. Then it analyzes the relief methods of network privacy abroad, and points out the points for reference to our country. Part 4th, in view of the current situation of network privacy, combined with the experience of overseas network privacy protection relief, Then it puts forward to establish and perfect the legal system of network privacy relief, clarify the relief mode of network privacy right in our country, establish the prohibition order, and perfect the way of network privacy relief in our country.
