【摘要】：作為一種法律制度,物權(quán)法深深地根植于特定的社會之中,并且與社會政治、經(jīng)濟及文化的聯(lián)系十分密切,同時又容易受到其他相關(guān)制度的影響。因此對物權(quán)法的研究,我們不應(yīng)閉門造車,而應(yīng)將其放在特定的社會背景中,研究其變化的規(guī)律,揭示其與社會基礎(chǔ)相吻合的物權(quán)制度的機理,使與人類生活關(guān)系最為密切的物權(quán)法制度能夠融入社會,既能使社會規(guī)律得以反應(yīng),又能更好地為社會大眾服務(wù)。今天,環(huán)境問題和生態(tài)危機已經(jīng)嚴(yán)重威脅到人類社會的生存和發(fā)展。我們的發(fā)展觀和倫理觀有必要進行重新審視。在“生態(tài)化”理念逐步滲透各個領(lǐng)域的同時,十分有必要考慮法律的生態(tài)化。而物權(quán)法又是法律體系中與人類關(guān)系最為密切的,自然也應(yīng)該將生態(tài)化的理念和保護環(huán)境的義務(wù)融入物權(quán)法中。筆者在參考大量國內(nèi)外相關(guān)資料的基礎(chǔ)上,研究物權(quán)生態(tài)化的理論基礎(chǔ)。在基于研究和反思傳統(tǒng)物權(quán)法的理論的基礎(chǔ)之上,對物權(quán)的生態(tài)化進行研究,并提出了一些自己的見解。本文主要由四部分組成:第一部分對傳統(tǒng)民法中的“物”及“物權(quán)”的概念進行創(chuàng)新,試圖從生態(tài)化的角度進行重新理解,也即從生態(tài)化的角度重新認(rèn)識物權(quán);第二部分分析物權(quán)生態(tài)化的理論基礎(chǔ),包括從法學(xué)、經(jīng)濟學(xué)及環(huán)境學(xué)等多角度入手分析;第三部分對我國物權(quán)生態(tài)化的立法的現(xiàn)狀及其中存在的缺陷進行研究和探討。在分析我國《物權(quán)法》現(xiàn)有規(guī)定對生態(tài)化理念體現(xiàn)的基礎(chǔ)上,進一步分析其存在的不足;第四部分針對我國現(xiàn)有的物權(quán)制度,提出從“生態(tài)化”的角度去進行改變的構(gòu)想。首先要奠定“物權(quán)生態(tài)化”的基調(diào),并且在此基礎(chǔ)之上,進一步完善現(xiàn)有的物權(quán)制度,并在此基礎(chǔ)上創(chuàng)立新的物權(quán)制度。
[Abstract]:As a kind of legal system, the real right law is deeply rooted in the specific society, and is closely related to the society, politics, economy and culture, at the same time, it is vulnerable to the influence of other related systems. We should not build it behind closed doors, but should put it in a specific social background, study the law of its change, and reveal the mechanism of the real right system, which is consistent with the social foundation. So that the system of property law, which is most closely related to human life, can be integrated into society, which can not only make the social laws reflect but also better serve the general public. Environmental problems and ecological crisis have seriously threatened the survival and development of human society. It is necessary to re-examine our concept of development and ethics. It is very necessary to consider the ecological nature of the law, and the property law is the most closely related to human beings in the legal system. Nature should also incorporate the concept of ecology and the obligation to protect the environment into property law. Based on the research and reflection of the theory of traditional property law, the ecological property right is studied. This paper mainly consists of four parts: the first part innovates the concepts of "thing" and "real right" in the traditional civil law, and tries to re-understand it from the angle of ecology. The second part analyzes the theoretical basis of real right ecology, including law, economics and environmental science. The third part studies and discusses the present situation and defects of the legislation of ecological property right in our country. On the basis of analyzing the embodiment of ecological idea in the existing regulations of Real right Law of our country, it further analyzes the shortcomings of its existence. In the 4th part, aiming at the existing real right system of our country, the author puts forward the idea of changing from the angle of "ecology". First of all, it is necessary to lay the tone of "ecological property right" and, on this basis, to further perfect the existing real right system. And on this basis to create a new real right system.
