【摘要】：音樂作品是音樂創(chuàng)作者、表演者、制作者等集體智慧勞動的結(jié)晶，，在表演、使用和播放這些音樂作品時，尊重音樂創(chuàng)作者的智力貢獻，為音樂創(chuàng)作者公平及時地支付勞動報酬，是理所應(yīng)當(dāng)?shù)�。只有合法保護音樂創(chuàng)作者的應(yīng)有權(quán)益，為其創(chuàng)作提供更好的社會環(huán)境，才會有更多優(yōu)秀的原創(chuàng)音樂作品回饋社會，才能保持文化事業(yè)不斷前進發(fā)展。音樂作品的法律保護隨著網(wǎng)絡(luò)媒體等通信的發(fā)展已經(jīng)成為了當(dāng)今國際上的一個難題，各國對于如何給予其法律保護，給予什么樣的法律保護，即采取何種法律保護模式，具體如何實施這種法律保護，存在著很多的分歧，而形成了不同的立法與實踐。本文擬針對現(xiàn)實案例演唱者與表演者之間的利益分配嚴重扭曲等幾個重點問題，就音樂著作權(quán)的保護作一分析和探討，以期對音樂作品的法律保護模式的適當(dāng)選擇，及相應(yīng)法律保護制度的合理構(gòu)建有所助益。 音樂著作權(quán)保護屬于《著作權(quán)法》保護范疇。本文第一章主要說明研究音樂著作權(quán)保護的目的和意義，論證了平衡創(chuàng)作者和表演者之間的音樂著作權(quán)收益的必要性；第二章從音樂著作權(quán)的法律內(nèi)涵出發(fā)，結(jié)合音樂作品的自身特點，闡明音樂著作權(quán)保護的法律價值；第三章總結(jié)出我國對音樂著作權(quán)的保護現(xiàn)狀，列舉出我國在音樂著作權(quán)保護的實踐中存在的問題；第四章根據(jù)國外對音樂著作權(quán)的保護實踐，歸納總結(jié)其對我國音樂著作權(quán)保護的立法啟示；第五章試從立法保護、行政保護、及司法保護等幾個方面，提出對我國音樂著作權(quán)保護的法律建議。
[Abstract]:Music works are the crystallization of the collective intellectual labor of music creators, performers and producers. When performing, using and playing these music works, they respect the intellectual contribution of the music creators and pay the music creators fair and timely remuneration for their work. Only by legally protecting the rights and interests of music creators and providing a better social environment for their creation, will there be more excellent original music works to give back to society. With the development of network media and other communications, the legal protection of music works has become a difficult problem in the world today. Each country has to give its legal protection and what kind of legal protection. That is, what kind of legal protection mode is to be adopted and how to implement this kind of legal protection, there are many differences. Different legislation and practice have been formed. In the light of the serious distortion of the distribution of interests between singers and performers in practical cases, this paper analyzes and discusses the protection of music copyright. It is helpful to the proper choice of the legal protection mode of music works and the reasonable construction of the corresponding legal protection system. The first chapter of this paper mainly explains the purpose and significance of the study of music copyright protection, and demonstrates the necessity of balancing the income of music copyright between creator and performer. The second chapter expounds the legal value of music copyright protection from the point of view of the legal connotation of music copyright and the characteristics of music works, the third chapter summarizes the current situation of music copyright protection in China. The author lists the problems in the practice of music copyright protection in China. Chapter 4th summarizes the legislative enlightenment of music copyright protection in our country according to the foreign practice of music copyright protection. Chapter 5th tries to protect the music copyright by legislation. This paper puts forward some legal suggestions on the protection of music copyright in China from the aspects of administrative protection and judicial protection.
