【摘要】：網(wǎng)絡(luò)服務(wù)協(xié)議是由網(wǎng)絡(luò)服務(wù)提供者單方面事先擬定的合同形式,應(yīng)在利益衡量視野下對(duì)網(wǎng)絡(luò)服務(wù)協(xié)議的特殊規(guī)則進(jìn)行平衡和補(bǔ)充。合同締結(jié)后,網(wǎng)絡(luò)服務(wù)提供者保有對(duì)合同條款隨時(shí)修改的權(quán)利,合同地位的平等性要求網(wǎng)絡(luò)服務(wù)協(xié)議條款"明示"性要求,保障用戶對(duì)合同條款合理審閱的權(quán)利;明確對(duì)用戶數(shù)據(jù)收集和利用的范圍,以及再利用和轉(zhuǎn)讓的途徑和程序,并將其一并進(jìn)行公示;建立第三方中立組織,對(duì)網(wǎng)絡(luò)服務(wù)協(xié)議進(jìn)行協(xié)同監(jiān)管。
[Abstract]:The network service agreement is the contract form which is drawn up by the network service provider in advance. The special rules of the network service agreement should be balanced and supplemented from the perspective of interest measurement. After the conclusion of the contract. Network service providers retain the right to modify the terms of the contract at any time, and the equality of the contractual status requires that the terms of the network service agreement be "expressly" required to ensure the user's right to review the terms of the contract reasonably; To clarify the scope of user data collection and utilization, as well as ways and procedures for reuse and transfer, and to make them publicly available; Establish a third-party neutral organization to coordinate the supervision of network service protocols.
