【摘要】：印刷時期的格式出版合同沿用于OA出版,已不能成功解決著作權問題,導致補遺協(xié)議功能強化,成為作者保留關鍵權利的法律工具,這與合同法的原則不符。OA出版中,出版者與作者只有平等、公平地處理著作權轉(zhuǎn)讓問題,補遺協(xié)議的功能才能得以準確界定,內(nèi)涵才能得以適當調(diào)整,才有利于作者、出版者、圖書館等使用者利益平衡。
[Abstract]:During the printing period, the format publishing contract used in OA publishing has not been able to solve the copyright problem successfully, which leads to the enhancement of the function of the supplementary agreement and becomes the legal tool for the author to retain the key rights. This is not in accordance with the principle of contract law. In OA publishing, publishers and authors only equal, fair treatment of copyright transfer, the function of the supplementary agreement can be accurately defined, and the connotation can be adjusted appropriately. Only in favor of the interests of authors, publishers, libraries and other users.
