私權(quán)自治中的政策介入研究

【摘要】:“私權(quán)神圣”是私權(quán)自治得以實(shí)現(xiàn)的重要法律精神,政策無權(quán)對私權(quán)自治進(jìn)行強(qiáng)制介入。然而基于法律的被動(dòng)局限性、執(zhí)法者的個(gè)人素養(yǎng)差異等等因素,使得政策介入私權(quán)自治的合理性大大提高。第一章以“法治社會”為制高點(diǎn),以“法治”起源為研究起點(diǎn),探究公法私法與公權(quán)私權(quán)的內(nèi)涵聯(lián)系,作為厘清政策與私權(quán)自治的關(guān)系的理論基礎(chǔ)。公權(quán)力掌握在政府手中,所以在制定上靈活性比較強(qiáng),執(zhí)行上強(qiáng)制性是政策實(shí)施的有力保障。法律是條框明確的硬性規(guī)定,它的存在給統(tǒng)治者和民眾以安全感,但卻會束縛統(tǒng)治者的政治思維,無法隨機(jī)應(yīng)變的制定政策以適應(yīng)全新的國家問題。第二章對私權(quán)自治體系的自身缺陷展開分析,通過“邏輯研究方法”和“文獻(xiàn)分析方法”對私權(quán)、私權(quán)自治、政策、民事政策等研究對象的定義進(jìn)行縷析,通過“比較研究方法”對政策介入私權(quán)的客觀現(xiàn)象在不同情況下的不同表現(xiàn),進(jìn)行比較和分析,更加全面的呈現(xiàn)政策因素介入私權(quán)自治的外觀與內(nèi)涵。政策作為一個(gè)非法學(xué)范疇的專業(yè)概念,必須立足于政治學(xué)理論內(nèi)容加以研究。本章節(jié)從政策介入私權(quán)自治的執(zhí)行強(qiáng)度來劃分政策的類型,基于此分類對不同強(qiáng)制力度的政策進(jìn)行分析。并基于私權(quán)的分類來開展研究私權(quán)自治,私權(quán)具體包含了人身性權(quán)利和財(cái)產(chǎn)性權(quán)利,兩類權(quán)利的特征、屬性和內(nèi)容都各有不同,受到政策介入的情形也各不相同。第三章基于上文對政策介入私權(quán)自治的理論關(guān)系進(jìn)行分類梳理,進(jìn)而分析政策介入私權(quán)自治的合理性。當(dāng)下的中國正處在社會轉(zhuǎn)型時(shí)期,社會的改革對于私權(quán)自治法律制度的沖擊和影響不斷加深,從而導(dǎo)致民事成文法的漏洞凸顯、政策因素介入范圍過大與社會轉(zhuǎn)型法律需求之間的沖突。此背景下,為避免政策在介入私權(quán)自治的過程中可能從良性違法轉(zhuǎn)為惡性違法,對于政策介入的范圍、限度以及政策介入私權(quán)的合理性、正當(dāng)性的研究,就顯得至關(guān)重要。通過對政策在程序合法與實(shí)體合法方面的分析,對介入私權(quán)的政策合理性、判斷標(biāo)準(zhǔn)等問題進(jìn)行探討,從公共利益與私人利益的沖突調(diào)整,到介入私權(quán)自治的政策實(shí)體標(biāo)準(zhǔn)到政策制定的程序標(biāo)準(zhǔn),綜合設(shè)定政策介入私權(quán)自治的合理性判斷標(biāo)準(zhǔn),以期對政策介入私權(quán)的制度構(gòu)建有所裨益。
[Abstract]:"the sacred private right" is the important legal spirit of the realization of private autonomy. The policy does not have the right to compulsorily intervene in the private right autonomy. However, based on the passive limitation of the law and the difference of the individual accomplishment of the law enforcers, and so on. The first chapter takes "rule of law" as the commanding point and the origin of "rule of law" as the starting point to explore the connotation of public private law and private rights. As a theoretical basis to clarify the relationship between policy and private autonomy, the public power is in the hands of the government, so it is more flexible in the formulation. Enforcement is the strong guarantee of policy implementation. The law is a clear frame of mandatory provisions, its existence gives rulers and the people a sense of security, but will constrain the rulers of political thinking. The second chapter analyzes the defects of private right autonomy system, through "logical research method" and "document analysis method" to private rights, private rights autonomy. The definition of policy, civil policy and other research objects is analyzed, and the different manifestations of the objective phenomenon of policy intervention in private rights under different circumstances are compared and analyzed through "comparative research method". More comprehensive presentation of policy factors involved in the appearance and connotation of private autonomy. Policy as a non-legal category of professional concept. This chapter divides the types of policies from the executive intensity of policy intervention in private autonomy. Based on the classification of different coercive force policy analysis. And based on the classification of private rights to carry out a study of private autonomy, private rights include the physical rights and property rights, the characteristics of the two rights. The attributes and contents are different, and the situation of policy intervention is different. Chapter three classifies the theoretical relationship between policy intervention and private autonomy based on the above. At present, China is in the period of social transformation, and the impact and influence of social reform on the legal system of private autonomy is deepening. As a result, the loopholes of civil statute law are highlighted, and the conflict between the excessive involvement of policy factors and the legal needs of social transformation. In order to avoid the policy in the process of intervention in the process of private autonomy may change from benign illegal to malignant illegal, the scope of policy intervention, limits and the rationality of policy intervention in private rights, the legitimacy of the study. Through the analysis of the policy in the aspects of procedural legality and substantive legality, this paper probes into the policy rationality and judgment criteria of the intervention of private rights, and adjusts the conflict between public interest and private interest. From the standard of policy entity to the standard of procedure of policy making, the rational judgment standard of policy intervention in private right autonomy is set synthetically, in order to benefit the system construction of policy intervention in private right.
