【摘要】:十屆人大第五次會議通過的《物權(quán)法》,首次制定了建筑物區(qū)分所有權(quán)制度,使得物業(yè)服務(wù)有了風(fēng)向標,在法律指引下更加規(guī)范化管理,為物業(yè)服務(wù)行業(yè)的蓬勃發(fā)展和業(yè)主權(quán)利的保護奠定法律基礎(chǔ)。然而《物權(quán)法》還有些不足之處導(dǎo)致業(yè)主權(quán)利受到廣泛侵犯,得不到有效的保護,因此,物業(yè)服務(wù)企業(yè)與業(yè)主之間的矛盾頻發(fā)。處理矛盾過程中,小區(qū)業(yè)主往往沒有優(yōu)勢,業(yè)主不懂得如何行使法律權(quán)利,使得業(yè)主權(quán)利被侵害。我國物業(yè)管理的法律制度初期并不專業(yè),現(xiàn)今雖然補充了專業(yè)化的法律法規(guī)但并不完善,物業(yè)服務(wù)企業(yè)不能正確的貫通法律規(guī)范的服務(wù)理念使得在實際操作中業(yè)主權(quán)利被廣泛侵害。綜上所述,物業(yè)管理中業(yè)主權(quán)利的保護作為身邊的熱點問題需要及時解決。筆者通過討論侵犯業(yè)主權(quán)利的情形和原因,對業(yè)主權(quán)利保護的法律法規(guī)提出了相應(yīng)的解決對策。本文主要從以下三個方面來分析物業(yè)管理中業(yè)主權(quán)利的保護。第一部分,主要介紹了物業(yè)管理與業(yè)主權(quán)利。首先解釋了物業(yè)管理的相關(guān)概念包括物業(yè)的概念,物業(yè)管理的概念以及物業(yè)管理的性質(zhì)。其中對物業(yè)管理的概念,本文認為應(yīng)采用廣義的概念而非狹義的概念。這一部分為后續(xù)論述提供理論依據(jù)。其次,介紹了業(yè)主權(quán)利。其中包括業(yè)主的概念以及業(yè)主權(quán)利的內(nèi)容。研討物業(yè)管理中業(yè)主權(quán)利保護問題,必然要先深入了解業(yè)主權(quán)利,因此,本節(jié)詳述業(yè)主權(quán)利相關(guān)內(nèi)容。第二部分,討論了實踐中侵害業(yè)主權(quán)利的情形及原因。物業(yè)服務(wù)企業(yè)對業(yè)主權(quán)利的侵犯可歸納為業(yè)主財產(chǎn)權(quán)益的侵犯和業(yè)主人身權(quán)益的侵犯兩類。筆者認為其產(chǎn)生的主要原因是:業(yè)主大會法律地位不明確、業(yè)主自治的不規(guī)范以及雙方壟斷問題。本章內(nèi)容主要闡述了物業(yè)服務(wù)企業(yè)侵犯業(yè)主權(quán)利的情形及原因。第三部分,通過以上兩章的分析概述,本章主要闡述了業(yè)主權(quán)利保護的法律對策。當今社會,物業(yè)服務(wù)企業(yè)侵犯業(yè)主權(quán)利的事件屢見不鮮,物業(yè)服務(wù)行業(yè)的發(fā)展也因此受到了阻礙。因此,本文就社會上存在的此種現(xiàn)實問題對物業(yè)服務(wù)企業(yè)侵犯業(yè)主權(quán)利的情形進行總結(jié),并分析其產(chǎn)生的原因,加之借鑒國外相關(guān)經(jīng)驗,提出了相應(yīng)的法律對策。筆者認為這有利于我國業(yè)主權(quán)利保護的完善。因此,應(yīng)明確業(yè)主大會的法律地位;完善業(yè)主自治與私法自治;政府適當介入及加強法制宣傳。
[Abstract]:The "property Law" adopted by the 5th session of the Tenth National people's Congress, for the first time, has formulated the system of building division ownership, which makes the property service have a wind vane, and is more standardized management under the guidance of the law. It lays a legal foundation for the vigorous development of property service industry and the protection of owners' rights. However, there are still some deficiencies in the property Law which lead to extensive infringement of owners' rights and lack of effective protection. Property service enterprises and owners of frequent contradictions. In the process of handling contradictions, the owners of residential areas often do not have an advantage, the owners do not know how to exercise legal rights. The owners' rights have been infringed. The legal system of property management in our country is not professional at the beginning, but it is not perfect even though it is supplemented by specialized laws and regulations. Property service enterprises can not correctly pass through the legal norms of the service concept in the actual operation of the owners' rights are widely infringed. To sum up. The protection of owners' rights in property management needs to be solved in time as a hot issue around us. The author discusses the situation and causes of infringement of owners' rights. This paper mainly analyzes the protection of owners' rights in property management from the following three aspects. The first part. This paper mainly introduces property management and owner's rights. Firstly, it explains the related concepts of property management, including the concept of property, the concept of property management and the nature of property management, among which the concept of property management. This paper holds that the concept of broad sense should be adopted rather than the concept of narrow sense. This part provides the theoretical basis for the subsequent discussion. Secondly. As a result:. The legal status of the owners' Congress is not clear. This chapter mainly expounds the situation and reasons of the property service enterprises infringing upon the owners' rights. The third part, through the above two chapters of analysis overview. This chapter mainly expounds the legal countermeasures of the protection of owners' rights. Nowadays, the property service enterprises violate the owners' rights frequently, and the development of the property service industry is hindered. This paper summarizes the situation of property service enterprises infringing upon the owners' rights, and analyzes the causes of their occurrence, as well as drawing on the relevant experience of foreign countries. The author thinks that this is beneficial to the perfection of the protection of the owners' rights in our country. Therefore, the legal status of the owners' Congress should be clarified. Perfecting owner autonomy and private law autonomy; The government should intervene appropriately and strengthen legal publicity.
