【摘要】：追續(xù)權(quán)由法國(guó)所首創(chuàng),旨在保護(hù)著作權(quán)人從作品后續(xù)交易中獲得收益的權(quán)利。盡管《伯爾尼公約》和《歐盟指引》都對(duì)追續(xù)權(quán)作出規(guī)定、目前世界上已經(jīng)有70多個(gè)國(guó)家承認(rèn)追續(xù)權(quán),但各國(guó)在追續(xù)權(quán)的用語(yǔ)、權(quán)力屬性及立法合理性上仍存在分歧。著作權(quán)人是針對(duì)后續(xù)交易本身而獲益,還是僅對(duì)增值獲益,以及獲益的計(jì)算方法;追續(xù)權(quán)究屬人格權(quán)、財(cái)產(chǎn)權(quán)還是復(fù)合性權(quán)利;規(guī)定追續(xù)權(quán)是否會(huì)對(duì)市場(chǎng)的經(jīng)濟(jì)效果產(chǎn)生影響,這些方面均存在以兩大法系為對(duì)立雙方的重大分歧。盡管中國(guó)著作權(quán)法修改草案的三個(gè)建議稿中對(duì)追續(xù)權(quán)有所提及,但目前沒(méi)有正式的追續(xù)權(quán)立法規(guī)定。在中國(guó)已經(jīng)成為全球第二大藝術(shù)市場(chǎng)的前提下,對(duì)追續(xù)權(quán)的立法很可能提上日程,因此,對(duì)追續(xù)權(quán)的內(nèi)容以及所涉及的爭(zhēng)議進(jìn)行梳理有重要意義。
[Abstract]:The right of continuation was first created by France to protect the right of copyright owners to benefit from subsequent transactions in works, although both the Berne Convention and the EU guidelines provide for the right of renewal. At present, more than 70 countries in the world have recognized the right of follow-up, but there are still differences in the terms, attributes of power and the rationality of legislation. The copyright owner benefits from the subsequent transaction itself. Whether to benefit only from added value, and how to calculate the benefits; The right to pursue and continue belongs to the personality right, the property right or the compound right; Whether the regulation of the right of follow-up will have an impact on the economic effect of the market. There are significant differences between the two legal systems in these areas, although the right of continuation is mentioned in the three proposals of the revised draft of China's copyright Law. However, there is no formal right of continuation legislation. In China has become the second largest art market in the world, the legislation of the right of renewal is likely to be put on the agenda. It is of great significance to sort out the content of the right of succession and the disputes involved.
