【摘要】：本文以一件典型的涉及"非技術(shù)特征"認(rèn)定的案例為切入點(diǎn),對如何認(rèn)定其創(chuàng)造性的問題提出了疑問,并對該案其他國家及地區(qū)的同族申請的審查過程進(jìn)行了比較和分析,同時,闡述了我國的相關(guān)規(guī)定和審查標(biāo)準(zhǔn),最后從其本身限定的方案出發(fā),對如何較為合理地認(rèn)定其中的特征并得出相應(yīng)的創(chuàng)造性結(jié)論進(jìn)行了探討。
[Abstract]:In this paper , a typical case involving " non - technical features " is taken as the entry point , and the question of how to determine the creative problem is put forward . At the same time , the review process of the application of the same nationality in other countries and regions of the case is compared and analyzed . At the same time , the relevant regulations and examination standards of our country are expounded , and finally , the characteristics of them are reasonably determined and the corresponding creative conclusions are discussed .
