【摘要】：隨著當(dāng)今商業(yè)化程度不斷加深,商標(biāo)作為一種市場識別和區(qū)分商品來源的工具,對社會的影響越來越大。而商業(yè)化的社會也不斷產(chǎn)生新的觀念、新的權(quán)益、新的創(chuàng)意、新的使用商標(biāo)的方式。一方面是商標(biāo)權(quán)人越來越具有權(quán)利意識,一方面是公共權(quán)益內(nèi)容越來越多樣化,商標(biāo)權(quán)人對商標(biāo)權(quán)的行使范圍與社會大眾享受公共權(quán)利的范圍都在不斷擴張,從而導(dǎo)致雙方的沖突增多,而解決這些沖突的手段就是商標(biāo)權(quán)的限制。 本文第一部分論述商標(biāo)權(quán)限制的基本內(nèi)容,包括商標(biāo)權(quán)限制的定義、商標(biāo)權(quán)限制的法理學(xué)分析,并從商標(biāo)的本質(zhì)功能逐步分析出商標(biāo)權(quán)的核心權(quán)益,從商標(biāo)權(quán)人與各個公共利益主體之間的關(guān)系,分析出公共利益的界限,并且對他們的利益進(jìn)行衡量,從而找到商標(biāo)權(quán)的限制所應(yīng)達(dá)到的要求。 第二部分分別論述了國外法對商標(biāo)權(quán)限制中的合理使用、在先權(quán)利、權(quán)利用盡的規(guī)定,這些規(guī)定從數(shù)量和內(nèi)容上都體現(xiàn)出外國立法對商標(biāo)權(quán)限制的不足這一現(xiàn)狀。 第三部分論述了我國法律法規(guī)的相關(guān)規(guī)定,包括我國的商標(biāo)法、相關(guān)行政法規(guī)和司法解釋以及地方性法規(guī)對商標(biāo)權(quán)限制的規(guī)定。體現(xiàn)出我國對商標(biāo)權(quán)有待進(jìn)一步研究的現(xiàn)實。 本文的第四部分分別論述商標(biāo)權(quán)限制中的合理使用、在先權(quán)利、權(quán)利用盡的現(xiàn)實狀況,并且結(jié)合各國法律以及典型案例對我國的立法完善和司法實踐提出相應(yīng)的建議。
[Abstract]:With the deepening of commercialization, trademark, as a tool to identify and distinguish the source of goods, has more and more influence on society, and the commercial society has also produced new ideas and new rights and interests. New ideas, new ways of using trademarks. On the one hand, the trademark owners have more and more right consciousness, on the other hand, the contents of public rights and interests are becoming more and more diversified. The range of trademark rights exercised by trademark owners and the scope of public rights enjoyed by the public are both expanding, which leads to the increase of conflicts between the two sides, and the means to resolve these conflicts is the limitation of trademark rights. The first part of this paper discusses the basic content of trademark right limitation, including the definition of trademark right limitation, the legal analysis of trademark right limitation, and gradually analyzes the core rights and interests of trademark right from the essential function of trademark. From the relationship between trademark owners and public interest subjects, this paper analyzes the limits of public interests, and measures their interests, so as to find out the requirements that should be achieved by the restrictions of trademark rights. The second part discusses the rules of reasonable use, prior rights and exhaustion of rights in the limitation of trademark rights in foreign law. The quantity and content of these regulations reflect the deficiency of foreign legislation on the limitation of trademark rights. The third part discusses the relevant provisions of China's laws and regulations, including our trademark law. Related administrative regulations and judicial interpretations as well as local laws and regulations on the limitation of trademark rights reflect the reality of our country's trademark rights to be further studied. The 4th part of this paper discusses the reality of reasonable use, prior rights and exhaustion of rights in the limitation of trademark rights. Combined with the laws of various countries and typical cases, the author puts forward the corresponding suggestions on the legislative perfection and judicial practice of our country.
