【摘要】：隨著電子商務(wù)行業(yè)的繁榮發(fā)展,網(wǎng)絡(luò)環(huán)境下的知識產(chǎn)權(quán)間接侵權(quán)日益增多。網(wǎng)絡(luò)交易平臺提供者雖然不是網(wǎng)絡(luò)交易中的當(dāng)事人,但是在預(yù)防與制止侵權(quán)行為方面起著重要作用。我國尚未建立完善的網(wǎng)絡(luò)交易平臺提供者注意義務(wù)制度,其注意義務(wù)的標(biāo)準(zhǔn)與范圍還處于相對不確定之中。同時(shí),研究成果的不足難以為制度構(gòu)建提供充足的參考資料。本文首先對網(wǎng)絡(luò)交易平臺提供者與注意義務(wù)進(jìn)行界定,闡述網(wǎng)絡(luò)交易平臺提供者注意義務(wù)的特殊性。其次從理論角度對注意義務(wù)的判斷標(biāo)準(zhǔn)與范圍進(jìn)行分析。在成立標(biāo)準(zhǔn)上,以英美法系的“三步檢驗(yàn)法”作為線索,對涉及可預(yù)見性、近鄰性、政策性的理論爭議進(jìn)行評析。在違反標(biāo)準(zhǔn)上,通過介紹合理人標(biāo)準(zhǔn)、專家標(biāo)準(zhǔn)、理性人標(biāo)準(zhǔn),結(jié)合學(xué)界觀點(diǎn),指出違反標(biāo)準(zhǔn)的應(yīng)然選擇。在范圍上,將注意義務(wù)細(xì)分為事前、事中、事后三種進(jìn)行類型化研究。最后,根據(jù)我國注意義務(wù)領(lǐng)域的立法現(xiàn)狀與司法現(xiàn)狀,結(jié)合前文的理論研究,針對法律制度不健全、實(shí)踐標(biāo)準(zhǔn)不統(tǒng)一、理論研究不深入三個(gè)存在問題提出相應(yīng)的對策。
[Abstract]:With the prosperity and development of e-commerce industry, the indirect infringement of intellectual property rights in the network environment is increasing day by day. The provider of network trading platform is not the party in the network transaction. However, it plays an important role in the prevention and suppression of tort. China has not yet established a perfect network trading platform provider duty of care system. The standard and scope of the duty of care are still in relative uncertainty. The deficiency of the research results is difficult to provide sufficient reference material for the system construction. Firstly, this paper defines the network trading platform provider and the duty of care. This paper expounds the particularity of network trading platform provider's duty of care. Secondly, it analyzes the judgment standard and scope of the duty of care from the theoretical point of view. On the establishment standard, it takes the "three-step test method" of Anglo-American law system as the clue. In violation of standards, through the introduction of reasonable human standards, expert standards, standards of rational people, combining with the academic point of view. In the scope, the duty of care is divided into three types: in advance, in the event, after the event. Finally, according to the current legislative and judicial situation in the field of duty of care in China. Combined with the previous theoretical research, the author puts forward corresponding countermeasures against the three existing problems, such as the imperfect legal system, the inconsistent practice standards and the lack of thorough theoretical research.
