【摘要】：版權(quán)補償金制度發(fā)軔于德國,推行于西方各國,而我國版權(quán)法一直未予引入。在數(shù)字復制技術(shù)應用環(huán)境下,由于私人復制進一步便利和普及,單靠現(xiàn)行的版權(quán)保護機制已不足以保護數(shù)字作品版權(quán)人的利益、規(guī)制復制者的行為,引入和適用版權(quán)補償金制度尤顯必要。版權(quán)補償金既非法定許可也非個別授權(quán),在法律性質(zhì)上屬于因合理使用而獲得的一種特別損失補償,是調(diào)整版權(quán)人與使用人之間利益關(guān)系的一種專門制度安排。
[Abstract]:The copyright compensation system originated from Germany, carried out in western countries, and the copyright law of our country has not been introduced. In the application of digital copying technology, because of private copying further convenience and popularity, rely on the existing copyright protection mechanism is not enough to protect the copyright of digital works to the interests of the people, the regulation of replication behavior, and the introduction of for the copyright compensation system is particularly necessary. Copyright compensation is neither legal license nor individual authorization, belongs to a kind of special compensation for reasonable use and in legal nature, is a kind of special institutional arrangements to adjust the relationship between the interests of copyright owners and users.
