【摘要】:2014年3月5日新修訂的《消費(fèi)者權(quán)益保護(hù)法》在全國(guó)正式實(shí)施并在新中國(guó)成立后的立法史上金融消費(fèi)第一次被納入消費(fèi)者的權(quán)益保護(hù)體系之中。它作為保護(hù)消費(fèi)者最基本權(quán)益的核心法律,對(duì)于消費(fèi)者基本權(quán)利部分的規(guī)定,是本部法律的點(diǎn)睛之筆。同時(shí),隨著對(duì)金融消費(fèi)者保護(hù)的意識(shí)提高,金融消費(fèi)者安全保障權(quán)作為金融消費(fèi)者的基本權(quán)利之一,必將成為構(gòu)建我國(guó)整個(gè)金融消費(fèi)者權(quán)利保護(hù)體系的根本。由于金融消費(fèi)者安全保障權(quán)的概念、具體內(nèi)容、如何實(shí)現(xiàn)其有效保護(hù)等問(wèn)題都懸而未決,這些將是本文重點(diǎn)探討的問(wèn)題。文章的內(nèi)容分為以下四個(gè)部分:第一部分是金融消費(fèi)者的安全保障權(quán)益相關(guān)概念的探討。首先闡釋了金融消費(fèi)者概念界定和爭(zhēng)議,還包含著對(duì)金融消費(fèi)者安全保障權(quán)概念的限制、擴(kuò)張與內(nèi)涵的分析,以期對(duì)金融消費(fèi)者安全保障權(quán)保護(hù)的理論進(jìn)行討論前提的明確。第二部分對(duì)金融消費(fèi)者保護(hù)相關(guān)的經(jīng)濟(jì)、法學(xué)理論進(jìn)行說(shuō)明,通過(guò)對(duì)金融消費(fèi)者安全保障權(quán)保護(hù)的理論基礎(chǔ)的論證,以及消費(fèi)者在金融消費(fèi)的現(xiàn)實(shí)中所面臨的保護(hù)困境,突出了安全保障權(quán)保護(hù)的必要性。第三部分介紹國(guó)外及臺(tái)灣地區(qū)有關(guān)金融消費(fèi)權(quán)益保護(hù)經(jīng)驗(yàn)的探究。其中包括國(guó)外目前對(duì)金融消費(fèi)者資產(chǎn)安全保障的相關(guān)措施,核心內(nèi)容包括有立法層面,機(jī)構(gòu)保護(hù)層面,金融消費(fèi)者的教育層面以及專門(mén)的糾紛處理層面等多個(gè)方面;第四部分結(jié)合我國(guó)現(xiàn)狀,通過(guò)對(duì)當(dāng)前金融消費(fèi)者安全保障權(quán)保護(hù)面臨的問(wèn)題進(jìn)行反思,對(duì)其保護(hù)的途徑進(jìn)行探索和設(shè)計(jì),試圖從制度、意識(shí)、監(jiān)管、救濟(jì)等方面全方位、多角度的實(shí)現(xiàn)我國(guó)完善的金融消費(fèi)者安全保障權(quán)保護(hù)體系的構(gòu)建。
[Abstract]:In March 5th 2014, the newly revised Law on the Protection of Consumer Rights and interests was formally implemented throughout the country and, for the first time in the legislative history of the founding of New China, financial consumption was brought into the protection system of consumers' rights and interests. The core law that protects the most basic rights and interests of consumers. The regulation of the basic rights of consumers is the finishing touch of this part of the law. At the same time, with the awareness of the protection of financial consumers, the right to security of financial consumers as one of the basic rights of financial consumers. It will become the foundation of constructing the whole financial consumer right protection system in our country. Due to the concept, concrete content and how to realize the effective protection of the financial consumer's security right, etc. These issues will be discussed in this paper. The content of the article is divided into the following four parts:. The first part is the discussion of the related concepts of the security rights and interests of financial consumers. Firstly, it explains the definition and controversy of the concept of financial consumers. It also includes the limitation, expansion and analysis of the concept of financial consumers' right to safety protection. With a view to the financial consumer protection of the right to safety and protection of the theoretical premise of a clear discussion. The second part of the financial consumer protection related to economic, legal theory to explain. Through the theoretical basis of the protection of the right to security of financial consumers, and consumers in the reality of financial consumption in the protection of the plight. The third part introduces the experience of foreign countries and Taiwan about the protection of financial consumption rights and interests. It includes the relevant measures of financial consumer assets security in foreign countries. The core contents include legislative level, institutional protection level, financial consumer education level and special dispute management level. Part 4th combined with the current situation of China, through the current financial consumer security rights protection problems faced by reflection, to explore and design the way of protection, trying to from the system, awareness, supervision. In the aspect of relief and so on, the construction of perfect financial consumer security protection system is realized from various angles.
