【摘要】：近年來,隨著各種“人流”廣告的不斷泛濫,“墮胎”已不再是那個(gè)曾經(jīng)令國(guó)人聞之羞澀、難以啟齒的詞語。人們觀念上的轉(zhuǎn)變、醫(yī)療技術(shù)上的進(jìn)步、甚至經(jīng)濟(jì)條件上的寬裕,都讓自愿“墮胎”成為分分鐘的“小事”。而與此同時(shí),卻又有如“強(qiáng)制墮胎”這樣的暴力行為屢見不鮮,讓被動(dòng)“墮胎”危及人權(quán)。正是這樣一個(gè)既面臨著泛濫,又隱藏著危害的“小事”,卻關(guān)系到婦女權(quán)利、家庭的幸福、社會(huì)的穩(wěn)定甚至民族的未來。而面對(duì)缺乏法律制約的墮胎行為,如何限制的同時(shí)更好地保障,就成為了擺在當(dāng)下的重要課題。本文將從墮胎權(quán)的概念和特征著手,結(jié)合我國(guó)的實(shí)際現(xiàn)況,分析我國(guó)墮胎權(quán)保護(hù)的立法現(xiàn)狀、執(zhí)法現(xiàn)狀、司法現(xiàn)狀,并試圖從多方面尋找原因。在此基礎(chǔ)之上,嘗試從法學(xué)理論的視角,以自由權(quán)、生育權(quán)等法律價(jià)值位階為理論背景,并參考國(guó)外關(guān)于墮胎權(quán)問題的研究,從范圍上和程序上兩個(gè)維度,為我國(guó)墮胎權(quán)的保障和限制提供理論上的依據(jù)、制度上的探索。通過本文的闡述,以期為我國(guó)彌補(bǔ)墮胎權(quán)的制度空缺問題引發(fā)更多人的關(guān)注和思考,從而實(shí)現(xiàn)生育權(quán)與其他權(quán)利的平衡發(fā)展。
[Abstract]:In recent years, with the continuous proliferation of "abortion" advertisements, "abortion" is no longer the words that once made Chinese people shy and inexplicable. People's concepts have changed, and medical technology has improved. Even economic conditions make voluntary abortion a miniscule "trivial matter." at the same time, violence such as forced abortion is common. Let passive "abortion" endanger human rights. It is precisely such a "trivial matter" which is faced with both the proliferation and the hidden harm, but it is related to the rights of women and the happiness of the family. Social stability and even the future of the nation. And in the face of the lack of legal restrictions on abortion, how to limit the better protection at the same time. This article will start from the concept and characteristics of the right to abortion, combined with the actual situation of our country, analyze the current situation of legislation, law enforcement and judicial status of the protection of abortion rights in China. And try to find the reasons from many aspects. On this basis, from the perspective of legal theory, with the legal value of the right to freedom, reproductive rights and other legal value as the theoretical background, and reference to foreign research on abortion rights. From the two dimensions of scope and procedure, it provides theoretical basis and system exploration for the protection and limitation of abortion right in China. In order to make up for the system vacancy of abortion right in our country, more people pay attention to and think about it, so as to realize the balanced development of reproductive right and other rights.
