【摘要】：一直以來,個人信息利用行為與人格權保護行為存在微妙的關系,引發(fā)了許多法律問題,但并未受到法律的足夠重視。然而,社會逐漸向信息化社會發(fā)展,促使個人信息的價值日益得以體現(xiàn)。在此過程中,人們在享受個人信息利用所帶來的便利的同時,也深刻地感受著因此所帶來的對人格權的限制。因此,研究個人信息利用與人格權保護的沖突與協(xié)調十分有必要。本文圍繞個人信息利用與人格權保護的沖突展開,通過分析沖突的根源,并借鑒其他發(fā)達國家的經驗及規(guī)范,力圖尋求個人信息利用與人格權保護的平衡點。第一章是對個人信息利用與人格權保護的概述,在確定個人信息的概念的基礎上概括其性質,并對個人信息利用的具體范疇進行了深入的分析,明確了個人信息利用與人格權保護之間的既有交叉又有矛盾的關系。第二章分析個人信息利用與人格權保護的沖突。該部分通過對個人信息利用的沖突的兩種方式,即利益沖突與權利沖突,并通過對于個人信息利用中的兩種沖突所包含的內容進行分析,充分的總結個人信息利用與人格權保護的沖突。第三章對其他國家個人信息利用的立法進行歸納并得出借鑒要點。通過深入總結各大國家個人信息利用的相關立法規(guī)范及法理依據(jù),最終得出發(fā)達國家的相關法律對我國的借鑒之處。第四章通過對我國個人信息利用立法現(xiàn)狀分析的基礎上,并吸收從他國法律中所總結的優(yōu)勢要點,分別從理論和制度兩方面提出個人信息利用法律制度完善的建議。
[Abstract]:All along, there is a subtle relationship between personal information use and personality right protection, which has caused many legal problems, but has not been paid enough attention by law. However, the society is gradually developing to the information society. The value of personal information is increasingly reflected. In this process, people enjoy the convenience brought about by the use of personal information, but also deeply feel the restrictions on personality rights brought about by it. It is necessary to study the conflict and coordination between personal information utilization and personality right protection. And draw lessons from the experience and norms of other developed countries, trying to find a balance between the use of personal information and the protection of personal rights. Chapter one is an overview of the use of personal information and the protection of personality rights. On the basis of defining the concept of personal information, it generalizes its nature, and makes a deep analysis of the specific categories of personal information utilization. The conflict between the use of personal information and the protection of personality right is analyzed in chapter 2. Chapter 4th through the use of personal information in China on the basis of legislative analysis of the status quo and absorb the advantages summarized from the laws of other countries. From the theory and the system, the author puts forward the suggestion of perfecting the legal system of personal information utilization.
