著作權(quán)與物權(quán)之關(guān)系的協(xié)調(diào)與立法完善

【摘要】:視覺藝術(shù)作品原件的轉(zhuǎn)讓會導致作品的著作權(quán)人和原件物權(quán)人分離為不同主體,這就使得協(xié)調(diào)兩者的關(guān)系進而協(xié)調(diào)兩者之間的利益成為亟待解決的問題。本文以我國《著作權(quán)法》第18條和送審稿第22條的比較為切入點,加之錢鐘書手稿書信案和赤壁之戰(zhàn)壁畫案的司法判決實踐,梳理著作權(quán)人和物權(quán)人關(guān)系協(xié)調(diào)的現(xiàn)狀,考察國外相關(guān)的立法與實踐,進而提出對著作權(quán)和物權(quán)之關(guān)系協(xié)調(diào)的立法完善建議。全文共分為五個部分。第一部分是著作權(quán)與物權(quán)之關(guān)系的理論基礎考察,主要分析了作品與作品載體的關(guān)系以及視覺藝術(shù)作品的著作權(quán)與原件物權(quán)的關(guān)系,并對《著作權(quán)法》第18條的合理性進行了論證。第二部分是著作權(quán)與物權(quán)之關(guān)系處理的法律困境,包括適用客體的延伸需求和《著作權(quán)法》第18條在實踐中的適用困境,得出第18條有何不足之處。第三部分是著作權(quán)與物權(quán)之關(guān)系的法條完善現(xiàn)狀,主要以草案送審稿第22條為基礎進行論證。第四部分是著作權(quán)與物權(quán)之關(guān)系處理的國外立法例考察,對德國、日本和美國在著作權(quán)和物權(quán)關(guān)系處理上值得借鑒的地方進行了分析。第五部分為著作權(quán)與物權(quán)之關(guān)系協(xié)調(diào)的立法完善建議,是筆者在以上四部分的論證基礎上對理論和制度的總結(jié)思考。
[Abstract]:The transfer of the original of the visual art works will lead to the separation of the copyright owner and the original owner into different subjects. This makes the coordination of the relationship between the two and then to coordinate the interests between the two becomes a problem to be solved. This article is based on the comparison between Article 18 of the copyright Law and Article 22 of the draft. In addition, the judicial judgment practice of Qian Zhongshu's manuscripts letter case and Chibi War murals case combs the current situation of the coordination between copyright owner and real right owner, and inspects the relevant legislation and practice abroad. Then the author puts forward some suggestions to perfect the relationship between copyright and real right. The whole paper is divided into five parts. The first part is the theoretical basis of the relationship between copyright and real right. It mainly analyzes the relationship between the work and the carrier of the work and the relationship between the copyright of the visual art work and the real right of the original. And the rationality of Article 18 of copyright Law is demonstrated. The second part is the legal dilemma of dealing with the relationship between copyright and real right. Including the extension needs of the applicable object and the dilemma of the application of Article 18 in practice, the author draws the conclusion of the deficiency of Article 18. The third part is the perfect status of the relationship between copyright and real right. The 4th part is the investigation of foreign legislation on the relationship between copyright and real right. Japan and the United States in the handling of copyright and real right relations are worth learning from the analysis of the place. 5th part of the copyright and property rights to coordinate the relationship between the legislative recommendations for improvement. On the basis of the above-mentioned four-part argumentation, the author summarizes the theory and system.
