【摘要】：基于房屋征收條例出臺(tái)后,房屋征收制度充分體現(xiàn)了公共利益和個(gè)人利益統(tǒng)籌兼顧、以人為本對(duì)被征收人給予公平補(bǔ)償?shù)男碌墓ぷ骼砟?在程序上對(duì)實(shí)現(xiàn)征收補(bǔ)償?shù)墓_透明、推進(jìn)“陽光征收”信息化提出了更高要求。本文擬從理論上引入“陽光征收”概念,接著從對(duì)《物權(quán)法》中房屋征收以及公共利益界定的相關(guān)法條分析入手,結(jié)合不同城市征收案例,提出推行“陽光征收”的重要性和必要性。隨后闡釋分析寧波市房屋征收工作,分析當(dāng)前寧波市房屋征收主要工作進(jìn)程和發(fā)展方向,以夯實(shí)其理論基礎(chǔ)和實(shí)踐操作根據(jù)。文章緒論部分分為研究背景和意義、國內(nèi)外研究現(xiàn)狀、研究思路與方法、研究創(chuàng)新與不足四方面,對(duì)本文寫作背景以及研究范圍和側(cè)重點(diǎn)進(jìn)行了總體的敘述。文章第二部分為相關(guān)概念及理論依據(jù)章節(jié),分三個(gè)部分,第一部分是概念界定,對(duì)房屋征收、陽光征收等專有名詞進(jìn)行詳細(xì)解釋;第二部分通過對(duì)《物權(quán)法》以及征收條例的解釋分析,作為本文的法律依據(jù),第三部分結(jié)合公共管理專業(yè)相關(guān)理論,奠定本文理論基礎(chǔ)。文章第三部分從四方面入手,主要是對(duì)寧波市近年來房屋征收以及“陽光征收”信息化工作作一詳細(xì)介紹和具體分析。首先簡要回顧寧波市“陽光征收”開展歷程,其次進(jìn)行寧波市房屋征收相關(guān)文件解讀,第三介紹主要工作措施和取得的階段性成效,最后分析當(dāng)前存在的幾點(diǎn)問題,其中詳細(xì)介紹主要工作措施和存在問題。文章第四部分為國內(nèi)其他城市房屋征收經(jīng)驗(yàn)借鑒,分三部分論述。分別選取上海市、貴陽市以及青島市等代表性城市相關(guān)工作開展情況,與寧波市展開對(duì)比,分析可借鑒之處。文章第五部分作為探討和建議章節(jié),本部分從思想認(rèn)識(shí)、方式方法、政策法規(guī)以及部門監(jiān)管等五方面分析指出寧波市“陽光征收”需要改進(jìn)的地方,結(jié)合實(shí)際提出針對(duì)性的五方面可行性建議,對(duì)“陽光征收”未來縱深化推進(jìn)提出創(chuàng)新性思路。
[Abstract]:Based on the introduction of housing collection regulations, the housing levy system fully reflects the public interest and personal interests of the overall consideration, people-oriented to the expropriated people to give fair compensation to the new work concept. In order to realize the transparency of expropriation compensation and promote the informatization of "sunshine expropriation", this paper intends to introduce the concept of "sunshine expropriation" in theory. Then from the "property Law" in the housing levy and the definition of public interest related to the analysis of the law, combined with different urban expropriation cases. This paper puts forward the importance and necessity of carrying out "sunshine expropriation", and then explains and analyzes the main work process and development direction of housing expropriation in Ningbo. In order to consolidate its theoretical basis and practical operational basis. The introduction of the article is divided into four aspects: research background and significance, domestic and foreign research status, research ideas and methods, research innovation and deficiencies. The second part of the article is divided into related concepts and theoretical basis chapter, divided into three parts, the first part is the definition of the concept, the collection of housing. Sun collection and other proper terms to explain in detail; The second part through the interpretation and analysis of the property Law and expropriation regulations, as the legal basis of this article, the third part combined with the relevant theory of public management. The third part starts with four aspects. This paper mainly introduces and analyzes the building expropriation and "sunshine expropriation" informatization in Ningbo in recent years. Firstly, it briefly reviews the development course of "sunshine expropriation" in Ningbo. Secondly, the paper interprets the related documents of housing expropriation in Ningbo. The third part introduces the main working measures and the achievement of the stage, and finally analyzes the existing problems. Among them, the main working measures and existing problems are introduced in detail. Part 4th is a reference for other cities' housing expropriation experience in China, which is discussed in three parts. Guiyang and Qingdao and other representative cities related to the development of work, compared with Ningbo City, analysis can be used for reference. Part 5th as a discussion and recommendations chapter, this part from the ideological understanding, methods and methods. Policies and regulations as well as departmental supervision and other five aspects of analysis pointed out Ningbo City "Sunshine Collection" need to be improved, combined with the actual five aspects of the feasibility of suggestions. This paper puts forward innovative ideas for the further development of "sunshine expropriation" in the future.
