【摘要】：王利民教授曾指出產(chǎn)權(quán)改革的本質(zhì)是法人所有權(quán)的變更,產(chǎn)權(quán)作為產(chǎn)權(quán)改革的關(guān)鍵點(diǎn),其是由"產(chǎn)"和"權(quán)"兩部分組成,所謂"產(chǎn)"是指財(cái)產(chǎn),而"權(quán)"則是指權(quán)利,那么企業(yè)產(chǎn)權(quán)改革則可以視為企業(yè)財(cái)產(chǎn)權(quán)的歸屬問題。本文在先后論述了產(chǎn)權(quán)改革與產(chǎn)權(quán)制度體系的相關(guān)內(nèi)容后,又結(jié)合產(chǎn)權(quán)改革浪潮對茶企產(chǎn)權(quán)制度體系構(gòu)建的民法意義進(jìn)行了簡要分析,并最后在產(chǎn)權(quán)改革浪潮下就茶企產(chǎn)權(quán)制度體系構(gòu)建的民法措施進(jìn)行了具體闡述。
[Abstract]:Professor Wang Limin has pointed out that the essence of property right reform is the change of legal person's ownership. As the key point of property right reform, property right is composed of "property" and "right". The so-called "property" refers to property. The "right" refers to the right, so the enterprise property right reform can be regarded as the ownership of the enterprise property right. This article has discussed the relevant contents of the property right reform and the property right system system successively. Combined with the wave of property right reform, this paper briefly analyzes the civil law significance of the construction of the property right system of tea enterprises, and finally expounds the civil law measures for the construction of the property right system of tea enterprises under the tide of property right reform.
