【摘要】：人為的作品專有秩序同相對(duì)獨(dú)立的作品傳播之間的矛盾是版權(quán)制度的固有矛盾,傳播技術(shù)革新則激化了這一固有矛盾。21世紀(jì)以來美國(guó)唱片業(yè)的維權(quán)歷程表明僅依靠健全的版權(quán)制度已不足以維持作品專有秩序。為維護(hù)版權(quán)秩序、維持版權(quán)制度的持續(xù)運(yùn)作,需調(diào)和版權(quán)制度的固有矛盾。調(diào)和固有矛盾的出路在于保障權(quán)利順利流轉(zhuǎn)并為最有效利用者掌握,使合法的作品傳播服務(wù)能夠通過市場(chǎng)競(jìng)爭(zhēng)壓倒非法的作品傳播行為。為保障權(quán)利流轉(zhuǎn),需在市場(chǎng)環(huán)境下處理版權(quán)與技術(shù)關(guān)系、維權(quán)費(fèi)用分擔(dān)、新舊版權(quán)產(chǎn)業(yè)競(jìng)爭(zhēng)這三大問題。在中國(guó),調(diào)和音樂作品版權(quán)保護(hù)固有矛盾的重點(diǎn)是以市場(chǎng)為基礎(chǔ),綜合運(yùn)用市場(chǎng)、行政與立法手段解決維權(quán)費(fèi)用分擔(dān)問題。
[Abstract]:The contradiction between the exclusive order of artificial works and the relatively independent dissemination of works is the inherent contradiction of copyright system. The history of the American record industry since the 21st century shows that it is not enough to rely on a sound copyright system to maintain the exclusive order of works. To maintain the continuous operation of copyright system, it is necessary to reconcile the inherent contradiction of copyright system. In order to protect the circulation of rights, it is necessary to deal with the relationship between copyright and technology in the market environment and share the cost of rights protection. In China, the focal point of reconciling the inherent contradiction of copyright protection of music works is to use the market as the basis, comprehensively use the market, administrative and legislative means to solve the problem of sharing the rights of rights.
