【摘要】:古人有云:“民以食為天”。我國市場經(jīng)濟的飛速發(fā)展推動了食品生物技術(shù)和食品生產(chǎn)工藝的快速進步,,極大的豐富了我國廣大人民群眾的餐桌。但是也必須認識到,現(xiàn)階段我國食品安全問題依然不容小覷,諸如蘇丹紅、瘦肉精、毒大米、毒罐頭、毒饅頭等,嚴重危害廣大人民的身體健康。這些有害物質(zhì)之所以能夠走上百姓的餐桌,很大一部分原因在于消費者很難通過有效的途徑獲取真實可靠的食品安全信息,這是我國消費市場存在的普遍的信息不對稱問題。在這種情況下,如何扭轉(zhuǎn)平衡這種不對稱,保護消費者的知情權(quán)就成為保證消費者食品安全衛(wèi)生的重中之重。同時,食品領(lǐng)域消費者知情權(quán)的維護有助于提升我國食品安全的整體水平,同樣也是保證社會穩(wěn)定的客觀要求。 消費者知情權(quán)制度構(gòu)建的最初目的在于通過保障交易過程中弱勢群體——消費者的正當權(quán)益來實現(xiàn)法律的公平和正義,進而保證實質(zhì)上處于不平衡狀態(tài)中的交易關(guān)系能夠順利恢復。但就目前來看,我國的相關(guān)法律仍不夠完善,或在相關(guān)規(guī)定方面較為籠統(tǒng),責權(quán)界定不明確、規(guī)制范圍不清晰等問題。這就要求我們不斷完善立法、明確責權(quán),為食品消費者知情權(quán)的保護提供堅實的法律基礎(chǔ)。 本文的研究主要采用了文獻研究法、案例分析法和比較分析法。首先,在廣泛搜集前人研究成果的基礎(chǔ)上,對本研究的主要概念和觀念進行闡述,奠定了本研究的理論基礎(chǔ)。其次,針對我國現(xiàn)行的關(guān)于食品消費者知情權(quán)保護的法律法規(guī)進行總結(jié)和歸納,同時對我國食品消費者知情權(quán)受侵害的案例及原因加以分析,從法律機制的角度找尋我國食品消費者知情權(quán)保護存在的問題和不足。然后對國外一些食品消費者知情權(quán)保護立法較為先進的經(jīng)驗進行對比分析,為我國食品消費者知情權(quán)保護提供一定的立法借鑒。最后,就我國食品消費者知情權(quán)保護的法律問題提出了相應(yīng)的建議和對策,旨在為我國相關(guān)立法的完善提供一定的理論參考。 在本研究中,主要研究內(nèi)容為我國當前市場經(jīng)濟環(huán)境下的食品領(lǐng)域消費者知情權(quán)的法律保護。通過分析,總結(jié)出我國食品消費者知情權(quán)保護的法律問題,即知情權(quán)的法律界定模糊,經(jīng)營者信息披露的不足,政府信息公開制度的缺陷,消費者協(xié)會功能缺失以及相關(guān)司法救濟機制的形式化五個方面。在此基礎(chǔ)上,結(jié)合美國、歐盟與日本的先進立法經(jīng)驗對我國形成有效借鑒,提出了完善我國食品領(lǐng)域消費者知情權(quán)保護法律機制的建議。
[Abstract]:As the ancients said, "the people take food as the sky". The rapid development of our market economy has promoted the rapid progress of food biotechnology and food production technology. It has greatly enriched the dining table of the broad masses of the people in our country. However, we must also realize that at this stage, the food safety problems in our country are still not to be underestimated, such as Sudan red, lean meat essence, poisonous rice, poisonous canned food, poisonous steamed bread and so on. Serious harm to the health of the general public. These harmful substances can go to the people's table, a large part of the reason is that consumers are very difficult to obtain real and reliable food safety information through effective ways. This is a general problem of information asymmetry in the consumer market in China. In this case, how to reverse the balance of this asymmetry. The protection of consumers' right to know has become the most important part of ensuring consumers' food safety and health. Meanwhile, the maintenance of consumers' right to know in the field of food helps to improve the overall level of food safety in China. It is also an objective requirement for ensuring social stability. The initial purpose of the construction of the consumer's right to know system is to realize the fairness and justice of the law by protecting the legitimate rights and interests of the weak groups-consumers in the course of transaction. So as to ensure that the transaction relationship in the unbalanced state can be restored smoothly. However, at present, the relevant laws of our country are still not perfect, or in the relevant provisions more general, the definition of responsibility is not clear. This requires us to improve legislation, clarify the right of responsibility, and provide a solid legal basis for the protection of food consumers' right to know. This paper mainly uses the literature research method, the case analysis method and the comparative analysis method. Firstly, on the basis of the extensive collection of previous research results, the main concepts and concepts of this study are expounded. It lays the theoretical foundation of this study. Secondly, the current laws and regulations on the protection of food consumers' right to know are summarized and summarized. At the same time, the case and reasons of the infringement of food consumers' right to know are analyzed. From the perspective of legal mechanism to find out the problems and shortcomings of the protection of food consumers' right to know. Then the comparative analysis of some foreign food consumers' more advanced legislation of the right to know experience is carried out. Finally, the author puts forward the corresponding suggestions and countermeasures for the protection of the right to know of food consumers in China. The purpose of this paper is to provide some theoretical reference for the perfection of relevant legislation in our country. In this study, the main research content is the legal protection of consumers' right to know in the field of food in the current market economy environment of our country. Through the analysis, the legal problems of the protection of the right to know of food consumers in our country are summarized. Namely, the legal definition of the right to know is vague, the lack of information disclosure of the operator, the defects of the government information disclosure system, the absence of the function of consumer associations and the formalization of the relevant judicial relief mechanism. On this basis. Combined with the advanced legislative experience of the United States, European Union and Japan, the author puts forward some suggestions on how to perfect the legal mechanism of consumer's right to know in the field of food in China.
