【摘要】：反向混淆在多國的判例中均被作為一種商標侵權形式,與傳統(tǒng)的正向混淆在構成要件、判定標準及對社會的影響方面都存在較大差異。它是指強勢企業(yè)使用了弱勢企業(yè)的商標,并采取廣告宣傳等方式,使得相關公眾誤以為弱勢企業(yè)的商標屬于強勢企業(yè)所有,亦或二者存在一定的關聯(lián)關系。從而導致原商標權人的商譽受損,意圖進一步拓展的市場空間被嚴重壓縮,不利于市場經濟的有序健康發(fā)展。然而,我國對這一問題無論是理論界還是實務界都尚無明確界定,造成諸多不便,因此對商標反向混淆侵權規(guī)制的探究尤為必要。本文擬從以下幾個方面對這一問題進行探究。首先,通過對反向混淆發(fā)展沿革及概念進行闡述,厘清其與正向混淆的關系;并通過法經濟學的分析視角,以期在反向混淆侵權規(guī)制方面有更清楚地認識。其次,從立法和司法兩方面分析我國反向混淆侵權規(guī)制的現(xiàn)狀,并從中梳理出當前我國存在的主要問題。再次,考察美國、日本、我國臺灣地區(qū)、歐盟及世貿組織對此的相關規(guī)定,在不同的模式下總結利弊并進行系統(tǒng)詳盡的分析。最后,借鑒國外的有利經驗并結合我國當前的現(xiàn)狀,一一對應的提出完善意見,主要從明確反向混淆的侵權性質、適用范圍、判斷因素、歸責原則及責任承擔方式方面展開,希冀對我國的立法及司法實踐有所裨益。
[Abstract]:Reverse confusion is regarded as a form of trademark infringement in many countries. There are great differences in the judgment standard and the impact on the society. It means that the strong enterprises use the trademark of the weak enterprises and adopt the way of advertising and publicity. Make the relevant public mistake that the trademark of the weak enterprise belongs to the strong enterprise, or there is a certain relationship between the two, which leads to the damage of the original trademark owner's goodwill. The market space intended to be further developed is severely compressed, which is not conducive to the orderly and healthy development of the market economy. However, our country has no clear definition of this issue, either in theory or in practice, which has caused many inconvenience. Therefore, it is particularly necessary to explore the regulation of trademark reverse confusion infringement. This paper intends to explore this issue from the following aspects. Firstly, through the development of reverse confusion history and concept are expounded. Clarify its relationship with positive confusion; And through the perspective of law and economics, in order to have a clearer understanding of the regulation of reverse confusion tort. Secondly, from the legislative and judicial aspects of legislation and judicial analysis of the status quo of reverse confusion tort regulation in China. And to sort out the current main problems in China. Again, to investigate the United States, Japan, China's Taiwan region, the European Union and the World Trade Organization on this related provisions. In different modes of summing up the pros and cons of the system and detailed analysis. Finally, learn from the beneficial experience of foreign countries and combined with the current situation in China, one-to-one corresponding suggestions. Mainly from the reverse confusion of the nature of tort, the scope of application, judgment factors, the principle of liability and the way to assume responsibility, hoping to be beneficial to our legislative and judicial practice.
