【摘要】：近年來(lái)，電視節(jié)目模板產(chǎn)業(yè)在全球范圍內(nèi)迅速發(fā)展，成為多個(gè)國(guó)家電視產(chǎn)業(yè)經(jīng)濟(jì)發(fā)展的重要組成部分。由于我國(guó)電視產(chǎn)業(yè)起步較晚，節(jié)目形態(tài)較為單一，從電視節(jié)目模板興起之初，國(guó)內(nèi)多家電視臺(tái)就以“克隆”的方式制作電視綜藝節(jié)目，這種“借鑒”無(wú)需對(duì)原作者支付任何費(fèi)用，，卻在節(jié)目?jī)?nèi)容和形式上進(jìn)行大量的復(fù)制抄襲，嚴(yán)重?fù)p害了原制作方和播出人的創(chuàng)作積極性和經(jīng)濟(jì)利益。從世界范圍看，目前尚未有國(guó)家對(duì)電視節(jié)目模板進(jìn)行明確保護(hù)，但英美法系和大陸法系國(guó)家以及部分國(guó)際組織都已在司法實(shí)踐和立法探索方面做出了一定的努力，對(duì)電視節(jié)目模板進(jìn)行法律保護(hù)成為現(xiàn)今全球電視產(chǎn)業(yè)界和法律界人士關(guān)注的重要內(nèi)容。 我國(guó)在電視節(jié)目模板立法上的缺失和司法實(shí)踐上的空白使得我國(guó)對(duì)電視節(jié)目模板的保護(hù)停滯不前，但近年來(lái)國(guó)內(nèi)因電視節(jié)目模板“克隆”引起的法律糾紛頻繁出現(xiàn)，成為困擾電視產(chǎn)業(yè)界和法律界的一大難題。隨著電視節(jié)目模板產(chǎn)業(yè)的迅速發(fā)展，迫切需要對(duì)電視節(jié)目模板的概念、法律屬性和立法研究進(jìn)行理論和實(shí)踐上的探索和研究。 本文第一章首先介紹了電視節(jié)目模板的研究背景及意義，對(duì)國(guó)內(nèi)外研究現(xiàn)狀進(jìn)行綜述，并提出本文的研究目的和創(chuàng)新之處；第二章對(duì)電視節(jié)目模板的內(nèi)涵界定、內(nèi)容構(gòu)成及法律屬性進(jìn)行探討，明確電視節(jié)目模板是具有獨(dú)創(chuàng)性的智力成果，具有可復(fù)制性，應(yīng)當(dāng)屬于著作權(quán)法保護(hù)的作品范疇，構(gòu)成本文的理論基礎(chǔ)和分析依據(jù)；在第三章中本文對(duì)國(guó)外電視節(jié)目模板保護(hù)現(xiàn)狀和保護(hù)難點(diǎn)進(jìn)行了詳細(xì)探討，并總結(jié)分析國(guó)外電視節(jié)目模板法律保護(hù)對(duì)我國(guó)的啟示；第四章對(duì)我國(guó)電視節(jié)目模板的法律保護(hù)現(xiàn)狀及問(wèn)題進(jìn)行了研究，指出我國(guó)現(xiàn)有法律保護(hù)制度無(wú)法對(duì)電視節(jié)目模板進(jìn)行有效保護(hù)；本文最后一章提出建立電視節(jié)目模板的著作權(quán)基礎(chǔ)保護(hù)制度，完善相關(guān)配套法律保護(hù)體系，同時(shí)發(fā)揮國(guó)際法保護(hù)作用，對(duì)電視節(jié)目模板進(jìn)行全方位的法律保護(hù)。
[Abstract]:In recent years, the television program template industry developing rapidly in the world, become an important part of the national television industry economic development. Because of China's TV industry started late, the program form is relatively single, from the rise of the television program template at the beginning, many domestic TV stations to "clone" of the making of TV variety show this "reference", without paying any fees to the original author, but copied a lot in the program content and form, serious damage to the original production and broadcast the creation of enthusiasm and economic benefits from the world, yet there are countries on the television program template of protection, but the British law and civil law countries and some international organizations have in judicial practice and legislative exploration made some efforts, on the television program template protection become the present world The important content of the television industry and the legal community.
China on the television program template the lack of legislation and judicial practice because of the protection of China's television program template is stagnant, but legal disputes in recent years due to domestic television program template "clone" caused by the frequent, become a big problem for the TV industry and the legal profession. With the rapid development of the television program template the urgent need for industry, the concept of television programs templates, to explore and study the theory and practice of the legal nature and legislation.
The first chapter introduces the research background and significance of the television program template, reviews the research status at home and abroad, and puts forward the research purpose and innovation; the second chapter defines the connotation of the television program template, discusses the content and legal attributes, clear the television program template is a highly creative intellectual achievements can be replicated, should belong to works protected by copyright law, constitute the basis in theory and analysis in this paper; the third chapter gives a detailed discussion on foreign television template conservation status and difficulties, and summed up the analysis of foreign television template legal protection inspiration to China; the fourth chapter legal protection status and on the issue of Chinese television program template was studied, pointed out that China's existing legal protection system can effectively protect the television program template; The last chapter puts forward the copyright protection system of TV program template, consummates the related legal protection system, and exerts the international law protection function, carries on the omni-directional legal protection to the TV program template.
