【摘要】：新市民是城市化過程中產(chǎn)生的數(shù)以億計(jì)的城市新群體。這個(gè)群體是城市化進(jìn)程的重要推動(dòng)者,也可能是城市化失序的肇因。本文以與新市民關(guān)聯(lián)度較高的民轉(zhuǎn)刑案件作為切入點(diǎn),在情境人性分析范式下,分析了文化人格錯(cuò)位情景下新市民的需求與行為取向,發(fā)掘并論證了新市民發(fā)生人性極化變異的深層次原因,得出沖突中的新市民因喪失了既有社會(huì)網(wǎng)絡(luò)的支撐,易于將民事糾紛升級為刑事犯罪的結(jié)論。便利的民事糾紛解決機(jī)制是新市民融入城市社會(huì)的必要社會(huì)支持網(wǎng)絡(luò)構(gòu)成要素,經(jīng)分析本文認(rèn)為從民轉(zhuǎn)刑案件的時(shí)滯效應(yīng)、新市民糾紛解決策略、民轉(zhuǎn)刑防控實(shí)踐、國際比較差距等方面看,我國民事糾紛解決機(jī)制仍有寬廣的提升空間�？尚刨嚨摹⒖山咏�、可視的、理性的民事糾紛解決機(jī)制是新市民迫切需要的社會(huì)支持來源。這個(gè)方向上的持續(xù)努力將大大降低民轉(zhuǎn)刑案件為表征的城市化失范現(xiàn)象。
[Abstract]:New citizens are hundreds of millions of new urban groups produced in the process of urbanization, and this group is an important promoter of the urbanization process. It is also possible to be the cause of the urbanization disorder. This paper takes the civil criminal cases with high degree of connection with the new citizens as the starting point under the paradigm of situational human nature analysis. This paper analyzes the needs and behavioral orientation of the new citizens under the situation of cultural personality dislocation, and explores and demonstrates the deep-seated causes of the polarization variation of human nature among the new citizens. It is concluded that the new citizens in the conflict have lost the support of the existing social network. It is easy to upgrade civil disputes to criminal offenses. Convenient civil dispute resolution mechanism is the essential element of social support network for new citizens to integrate into urban society. Through the analysis of the case from the civil to criminal delay effect, new citizen dispute resolution strategy, civil crime prevention and control practice, international comparison gap, and so on. China's civil dispute resolution mechanism still has broad room for improvement. Reliable, accessible, visible. Rational civil dispute resolution mechanism is the source of social support urgently needed by new citizens. The sustained efforts in this direction will greatly reduce the phenomenon of urbanization anomie represented by the conversion of people to criminal cases.
