【摘要】：中國大陸于2007年3月16日由第十屆全國人民代表大會(huì)第五次會(huì)議決議通過《物權(quán)法》,并自同年10月1日起施行。在《物權(quán)法》起草之初即有部分學(xué)者著眼于現(xiàn)代社會(huì)現(xiàn)象,參照世界各國對(duì)于物權(quán)的界定及種類,對(duì)傳統(tǒng)物權(quán)法所規(guī)定的物權(quán)項(xiàng)目或原則有著不同的主張,例如“物權(quán)法定主義”的存廢。臺(tái)灣地區(qū)于2010年2月3日公布增訂“民法物權(quán)篇”有關(guān)區(qū)分地上權(quán)的第841之1至之6條文,承認(rèn)土地上下一定空間范圍內(nèi)設(shè)定地上權(quán)之必要,明顯受到中國大陸《物權(quán)法》中第136條空間權(quán)立法之影響。
