【摘要】：買賣不破租賃規(guī)則創(chuàng)設(shè)的初衷是保護弱勢承租人的合法權(quán)益,但由于當(dāng)前我國立法的缺失和制度的漏洞,債務(wù)人通過串通案外人設(shè)定虛假租賃,使租賃成為其與債權(quán)人乃至法院談判與對抗的籌碼,債權(quán)人的權(quán)利被進一步削減甚至無法實現(xiàn),司法裁判的權(quán)威與公信力也將受到嚴重損害。因此,租賃權(quán)要獲得對抗不特定第三人的效力,必須符合"權(quán)利對于第三人之對抗效力與權(quán)利之公示作用應(yīng)相伴而生"的民法基本原理。在現(xiàn)行法律框架之下,結(jié)合執(zhí)行實踐經(jīng)驗,可以賦予登記、占有、公證、訴訟等方式以公示公信的效力,案外人所主張的租賃符合這些公示方式的,應(yīng)當(dāng)認定其效力;執(zhí)行法院決定對租賃予以保護的,應(yīng)當(dāng)以承受主義為原則,但承租人另有主張的除外。

Therefore, the right to lease is not specific to the third party. It must comply with the basic principles of civil law, that is, the right to fight against the third party and the publicity function of the right should be accompanied by it. Under the existing legal framework, implementation experience combined, can give the registration, possession, notarization, litigation and other ways to the effectiveness of public trust, the outsider advocated leasing meets these public way, should recognize its effectiveness; the court decided to protect the lease, shall bear in principle, but the people who claim otherwise except.
