【摘要】：本文首先對歷史上的遺忘權(quán)和刪除權(quán)進(jìn)行比較,進(jìn)而探討被遺忘權(quán)的合理性與缺陷。在對被遺忘權(quán)的人格屬性和財(cái)產(chǎn)屬性的分析和其與"再傳播"的比較中得出確立被遺忘權(quán)的理論依據(jù)后,討論其與言論自由的沖突,揭示其對不平等合同的補(bǔ)充性作用。最后將之定位為人格權(quán)并提出了本土化的展望。
[Abstract]:This article first compares the right of oblivion and the right to delete in history, and then discusses the rationality and defects of the right to be forgotten. After analyzing the personality attribute and property attribute of the forgotten right and comparing it with the "re transmission", we get the theoretical basis of establishing the right of oblivion, then discuss the conflict between it and freedom of speech, and reveal its supplementary role to the unequal contract. Finally, it is defined as the right of personality and the prospect of localization is put forward.
