【摘要】：好撒馬利亞人法是國外對保護善意救助者法律的統(tǒng)稱,主要包括救助者的救助義務、責任豁免、請求權三方面的內容。我國民法將其稱為見義勇為,并將其性質界定為無因管理。我國民事法律體系中欠缺救助者對被救助者損害賠償責任減輕的規(guī)定,應當借鑒國外好撒馬利亞人責任豁免的基本規(guī)則,將救助者的侵權責任限制在故意和重大過失,且一般過失不承擔責任�，F(xiàn)階段地方性法規(guī)作為好撒馬利亞人法中國化的率先途徑,有權規(guī)定救助者對被救助者造成損害的責任豁免,為未來我國民法典在無因管理制度中規(guī)定緊急無因管理從而實現(xiàn)好撒馬利亞人法的全面中國化積累經驗。通過解決救助者、被救助者以及其他人之間侵權責任承擔的問題,實現(xiàn)好撒馬利亞人法在民事法律體系內部的協(xié)調。
[Abstract]:The good Samaritan law is the general name for the law of protecting the bona fide salvor in foreign countries, which mainly includes three aspects: the salvage's duty of relief, the exemption from duty and the right of claim. The civil law of our country calls it righteous and the nature of it is defined as non cause management. In China's civil law system, those who lack the relief liability of the salvor's liability for damage compensation should draw lessons from the basic rules of the good Samaritan's immunity from liability, and limit the tort liability of the salvor to intentional and gross negligence, and the general negligence is not liable. The first way to local regulations at this stage as the good Samaritan law of Chinese, have the right to relief provisions of exemption from liability by the rescuer causes damage, for our future civil code in the absence of requirements for the management system of emergency management so as to realize the good Samaritan law full of China experience. By solving the problem of tort liability between rescuers, rescuers and others, we can achieve the coordination of good Samaritan law in the civil legal system.
